Example of Consent letter for child immigrate? for K1 & K2

Sometimes this answer can be country-specific as to what's required in terms of parental consent for the child to move.  What's the country of origin?

If China, then either a notarized letter or a full custody/sole fostering statement in the divorce decree (if parents of child were previously married).  

 

The letter doesn't need to be too complicated---basically stating all names (father, mother, child), and that he gives written consent for the child to permanently move to the USA with the mother.  His signature, the date, and get it notarized.  I would also include his contact information as well in the letter, as a further show of good faith in signing.

Yes my original country is China. And I try to get the notarized letter with sole custody before, but the officer rejected to do that. They said it's illegal in China. Both parents have the custody and nobody can 'give up' until die.

 

And now we're planing to get the notarized letter from child's father to claim he consents the child immigrate with mom (me).  I hope it works.

I think I will make sure to put all information on the letter, just in case if the USCIS will ask for more document or files. It will waste time.

You mean having the officer notarize just a letter stating you had full custody?  If so, I can see why the officer rejected that idea.  That would only have worked if you were granted sole custody/100% fostering as stated in the divorce decree.

I see but my case is a little bit special because I didn't get married (I'm unmarried and single mom)

 

So I don't have any divorce order or decree. But I went to notary department with child's father together. And he said he would like to 'give up' the custody rights. Even so, the office still rejected to write that.

Ah...ok...Now I understand a bit more why the officer rejected that--- it was a good thing because for the child's father it protects his rights.  

Consent for the child to move, and giving up parental rights are completely different things.  The officer was in this case looking out for the child's biological father in protecting his legal right to the child.

 

The notarized letter of consent for the child to move to the US (NOT consent that he is giving up parental rights) is what you need.

Timeline

Good point. My wife had sole custody of their son, and he was 18 years old at the time. But to avoid any possible travel/custodial issues, she and her ex crafted a letter authorizing his son to move to the US, had it notarized, put in White Book format. That was 2012, today the son lives with us in the US, is a college graduate. He has seen his father several times on his infrequent visits back to China. The father helped with his son's college tuition.

I did it for the same reason... You could use this :

 

Letter of parental consent

 

I the undersigned, XXXXXX, born on date in city, biological father of name of child, born on date in city , do hereby give my written consent for his/her to immigrate to the United States of America as a K2 visa holder, accompanying his/her biological mother, XXXX, born on date, in city, as a K1 visa holder.

This letter of consent is being issued on date at city, in compliance with immigration requirements for the United States of America.

You're welcome... BTW I don't think you need this. You just need his consent and his willing to come to USA is nothing to do with that. So my advice will be just asking for him the letter of consent.
