K2 Follow to Join

Good day. 

 

My question is:

 

If I indicate the K2 follow to join in the DS-160, am I the only one who should go the the interview at the Embassy?
 

Or do I have to bring my child with me and be interviewed together and if we get approved, the child would get the 1 year follow to join K2 visa?

Your fiancé filed just for you but in your petition stated that you have a child, so I also presume that it's just one petition. If your child has been mentioned in the petition and ds160, it simply means that he is eligible to follow on a k2 visa within 1 year of your arrival in the states imo and no he does not need to go with you for the interview if just one petition was filed.

No such thing as a one year k2 follow to join visa.   Follow to join simply means you have up to one year after the issuance of the k1 to apply for the k2

DS-160 is a visa application form. And a  K-2 has to have her/his own, separate  DS-160. . So two DS-160 - one for you, one for your child. 

 

Same with medical - has to be done for both of you.

 

Interview can be scheduled for the same time as for a a K-1 parent. Or not - all depends on WHEN a K-2 is ready to join a K-1 parent (within a year from the date of a K-1 visa issuance).

We are currently preparing documents needed for the  i-129f. In the Cover Letter for the i-129f can we include in the petition that we are also applying for K2?

Or we just do that in the DS-160 after the i-129f is approved?

You have to be certain to follow the Form I-129F instructions about when and where to list all of the children on the petition. https://www.uscis.gov/sites/default/files/files/form/i-129finstr.pdf  That is all that is needed at this stage of the process.

Your case was filed just for you i presume? If you have a minor child you should have mentioned in the original petition and there should be a section in the ds160 which will be refering to your child and you will be asked if he/she will be coming at a later date or if you are traveling with the child, you will select the one which refers to your case, meaning you are travelling alone and within a year you will have to file for a k2 for your kid to come join you here in the states.

The child is included in the form I-129f. But the child will follow within a year.

 

I have another question.  If the child is 18 y/o when the time the K1 visa is filed there would be no issues on the K2 visa? She can still follow within a year? By the time we get married the child will be 18 already.

A K-2 visa can be issued to a child who is under 21 years old and unmarried.  

So, if she applies for a K-2 visa within a year  (from the date a K-1 visa was issued for her parent), she should be just fine. 

My son, as many others K-2s,  arrived after me, and he was  over 19 when he entered the US.

A K-2 does not need to be under the age of 21 when he/she gets his green card.  This based on the BIA's 2011 decision, which  can be read at  http://www.justice.gov/sites/default/files/eoir/legacy/2014/07/25/3719.pdf.
So, as long as  a K-2 entered the U.S. before a K-2 turned 21, he/she  is safe.

You are correct. I stand corrected. I should have realized/remembered that. That is the how my stepson is now a LPR with a 10-yr GC is where he is today. Why not now go for USC? That is the stuff for another discussion in another VJ forum.......:whistle:
