So my husband has finally been scheduled for an interview after 8 months of waiting. His biometrics was October 1. 2018.  My husband has met all the requirements of citizenship. Weve been married for over 10 years. Our only problem is after he applied for the n400 he got a simple property damage charge which he paid 180$ restitution. I wish it never happened but it did. Does anyone have any advice for us before his interview?

I do not think, it will be an issue, just take paid receipt with him.  He is a law-abiding US resident and will be an excellent US citizen soon.

Thankyou. I am getting nervous. He did have a charge that was completely dismissed about 7 years ago. So this one would be his only conviction.

[1] You need to take all the records of the charge completely dismissed 7 years ago, if it  comes up anyway during interview.  Did you disclose the event in your N-400?

[2] Was the property damage action an accident or intentional ?

The dismissed charge from 7 years ago was disclosed in the n400 with court certified documents as well. This property damage was not disclosed because it happened AFTER the n400 was sent. It was definitely not intended. Somthing that just happened. A person was harassing my hubby outside my hubbys business and my husband out of frustration hit the mans side driver window to his car and it cracked.  He paid restitution to the man. He plead not guilty and the charges were dismissed when he payed the restitution. Now I’m just stresssing out about it and hope everything goes well.

I will wait for others to comment also, but since you paid the fine and charges were dismissed and you have proper documentation to back it up, you will be fine.

You do not have to stress over this. Please have him disclose this at his interview because they will ask if any convictions (arrested or not) were done.

We will bring the certified court papers to his interview. Do u know anyone who has gone through a similar situation?  It has been hard not to stress over it.

I don't know any one specifically but if you comb thru Visa Journey, you'd find some members who have gone thru this.

It is important to remember that DOH officials have access to ALL security sites with information on everything that has happened to any person....police, immigration, etc. For example, they could question your spouse on the incident, be looking at it smack dab on their screen and then he may deny it or fail to mention it to the officer....that would definitely be grounds fro N400 denial :(

So, good idea to take it with you to the interview and declare it to the officer as a "change in situation" since waiting for the N400 interview to be scheduled.
