Hey everyone,

 

Thanks for all the personal experience you provide in all of the topics, it means so much!

My spouse and myself are in a problem, and I would greatly appreciate your opinions and guidance to the possible solution.

 

We have filed for AOS in the beginning of April, finished with biometrics at the end of April, and we were ready to wait for 6.5 - 8.5 months to get my EAD/AP as the processing times have moved up.

Few weeks ago, my spouse has been laid off and is to stay at work until the end of June.

We have been applying for jobs non stop ever since, but no luck. None.

If this situation (no job interviews or anything) continues, we are going to be able to survive the June, but we will not be able to pay the rent in August unless I get the EAD and possibly start working.

 

We tried reading every thread on this topic we could, but we still have some questions that we could not find the answer to in the forums.

 

1. How important is the job offer for myself in our case, in your opinion? Considering how I did not apply for jobs for myself yet (didn't have the EAD yet and approval is months away), and will probably take at least few weeks/months to get anything, if at all, I am afraid that we will not have a "solution" (job offer) to the "problem". I have an option to work freelance and earn just enough for us, and can maybe state that as a "solution"? Would that work?

 

2. If we manage to get a job offer for me somehow (begging or something), do I have to accept it? Say, we get a job offer for myself from the local convenience store to work as a part time clerk for almost to nothing, which would not help us to survive.

 

3. If we get rejected (god-i-hope-not) for expedition of my EAD, could including congressman right away after rejection change anything?

 

4. I have read that some of you have recommended updating the I-864 for the interview and present it only if the officer asks for it, but if we request an expedite EAD and note that the severe financial loss is due to the I-864 sponsor has no job anymore and we have no income, does the situation changes? We wouldn't want to omit this information/document at the interview because I feel like that would not be fair.

A job offer is a good reason to request an expedite and as a matter of rule always best to go the expedite route as you have found out.

 

I am not aware that there is any discrimination of what type of job offer, nor would it be logical there was.

 

Getting anything processed by August may be optimistic.

We will try to get a job offer for me if we don't manage to secure another job for my spouse in the following two weeks.

 

Why do you think that processing expedite EAD by August might not be possible?

My understanding was that it usually takes up to a month from the date of request to expedite before you get your card.

I would go for the Expedite whatever happens.

 

Expedite is quicker, but I have never seen a specific timeline, could be a months, could be longer. You have not even started the process and August is 6 weeks away.

Thank you so much for the advice and how quick you're responding!

 

I will keep the thread updated with our timeline after we request expedition.

It will be useful to people in similar situation as we are.

 

If anyone has an advice for questions #3 & #4 from the op, please do share your opinions.
