Seems the CO does not see it that way or would not be asking for a divorce decree. Maybe whatever was done was not up to the needed legal standard.

To be really honest, you may be screwed if Texas doesn't consider him divorced. If he wasn't divorced completely before you were married, then your marriage is bigamist and that's a very big deal.  Yes we have seen it before.  It requires a lawyer to sort out the situtation.  

 

EDIT:

You can't just divorce anywhere in the world.  You normally need to be a resident of the location you file for divorce in.  Even in the USA, you can't get divorced in Colorado if you live in Utah or New York.

Yess he got married in Pakistan to a Pakistani woman. He was in Pakistan when he initiated the  divorce and later on went back to texas.

It doesn’t matter if his ex wife knew he was trying to get divorced/believed he was divorced. Bigamy is when you marry someone whilst still married to someone else - it doesn’t matter who knows about it. If his Pakistani divorce isn’t considered binding in the US and he has married you...then yeah, unfortunately, that probably does make him a bigamist...an accidental bigamist, but still...

 

Not trying to be harsh, but it isn’t something to just ignore - it could have a serious consequence.

If you provide a divorce decree dated after you got married, then you are not legally married.  You will then have to get married after the divorce decree and then refile I-130.  However, you need a lawyer for this immigration problem.

He needs to get divorced, marry you and file the I-130.

His father had the power of attorney from his side while no response from the other side was seen.. divorce happened by default.

But we are already married... our paperwork is registered. How can we remarry. At this point I wanna cry as this immigration process has already sucked the life out of us.

So he wasn't even in Pakistan when the divorce was completed and he wasn't a resident of Pakistan when it started.  He just happened to get married in Pakistan originally to a wife he already petitioned for who was Pakistani.

 

I think you will have bigger issues but I have been pleasantly surprised before.  He should have divorced in Texas where he was a resident originally.
