JUST HAD MY INTERVIEW ON JUNE 13 2019. AFTER THE INTERVIEW THEY HANDED ME 221 G WHITE SLIP AND ASKED TO SEND A DIVORCE DECREE OF PETITIONER (HUSBAND) FROM A PREVIOUS MARRIAGE FROM TEXAS USA.WE SUBMITTED A DIVORCE DECREE DONE AND ATTESTED  FROM PAKISTAN.MY HUSBAND INITIATED THE DIVORCE FROM PAKISTAN BUT V.O SAID WE NEED IT FROM TEXAS.IT TAKES MINIMUM 90 DAYS THERE . AFTER THE INTERVIEW I CHECKED CEAC WEBSITE  IT  IS THE SAME AS BEFORE NO CHANGES.WHAT SHOULD WE DO?WILL THE STATUS BE UPDATED OR IT WILL REMAIN THE SAME UNLESS WE SUBMIT THE REQUIRED DOC.  ANY ADVICE WILL BE APPRECIATED BECAUSE REALLY DEPRESSED AND HEARTBROKEN.THANKYOU

I'm sorry you had to go through that. So you haven't submitted the final divorce degree from the state of Texas like the officer requested?

Don’t worry about the what the status mentions, tell your husband to get the divorce process going, get the decree, and submit it as directed. As you already mentioned, it may take 3-6 months for the divorce process. So just wait till then.

If he is in Texas, he can go down to the courthouse and request a certified copy, then have him scan it to you to send to them. You won't see a change in the status until you send that in. Once you do, it will go into AP while they process it.

 

Don't worry, people have gone through this before. Just send them what they asked for and hopefully they approve you soon, Nshallah.

HE HIRED A LAWYER AND SHE IS LIKE YOU HAVE TO DO THE PROCEDURE ALL OVER AGAIN HERE IN TEXAS ACCORDING TO OUR LAWS  WHICH CAN EASILY TAKE 90 DAYS MINIMUM.

If not then he probably needed to get divorced where he lives which was Texas.  If he wasn't properly divorced before you were married, you may have more issues.  Your petition will not expire.  But if you do not provide the information that has been asked for within the time frame it is required, then it will be eventually returned to the USCIS.   Currently your petition and visa package are sitting at the embassy. 

Thankyou for replying. yess he lives in texas at the moment. when he initiated the divorce he was in Pakistan but came back to texas. we didn't know that before thought Texas recognizes foreign divorces. V.O kept asking for divorce decree from Texas which we didn't have.i had the settlement agreement from Texas but it was not  the final divorce decree. he gave me 221g paper asking for the divorce decree.. Are we screwed?

so if we provide the required divorce decree will our marriage still  be not recognized. OMG have u seen such cases in the past ?

You will have to obtain the Texas final divorce decree. What he previously married to another Pakistani woman?  Did they marry in Pakistan?  What made him to divorce in Pakistan instead of Texas? Did he follow all the rules for divorce in Pakistan?

 

To be really honest, you may be screwed if Texas doesn't consider him divorced. If he wasn't divorced completely before you were married, then your marriage is bigamist and that's a very big deal.  Yes we have seen it before.  It requires a lawyer to sort out the situtation.  

 

EDIT:

You can't just divorce anywhere in the world.  You normally need to be a resident of the location you file for divorce in.  Even in the USA, you can't get divorced in Colorado if you live in Utah or New York.

Confusing but no divorce may be bigamy in the US but not Pakistan.

 

Assuming this is the case then he first needs to get divorced, then he can marry you and petition you to immigrate to the US.
