She posted that they were her parents here. So no not the baby's soon to be adopted parents. 

Plus if she puts the baby up for adoption there is no child support going to anyone.

I don't disagree that she made some mistakes, but the reality of it is she has very few options with the USC fiancé apparently not in the picture anymore.  Her only questions were could the I134 be pressed against him, and could he be sued for child support once the baby is born.  The simple answers to both are no and yes as several other posters have already mentioned.  Everything else is just curiosity, and with the OP not back to clarify anything, it is what it is.

 

I wish the OP good luck with her future, and I am sorry this journey did not work out for her, but short of reconciling with the fiancé, her only option is to leave before the I94 expires to avoid any future immigration plans if she so intends.

The K-1 visa comes with several limitations. Bottom line:  Without the support of her fiance, she has no legal path to remain in the US.  There is no helping her to stay unless she marries the original petitioner.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

 Why on earth would you want to stay if he says the relationship is over? You’re visa becomes void, go home to your family... if you’re keeping the baby, the USA has laws that will require him to pay child support if the baby is his regardless of where you live in the world.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

requiring him to pay and collecting that payment are 2 separate activities, lot of people can claim inability to pay, the person (USC) sounds a little young and non-committal

I am curious how far along is the pregnancy. If she stays full duration of I-94, she might be too far along to be allowed on the airplane. How old does the child need to be before it can petition for the Mother?

A citizen must be 21 years old to petition a parent.

Hopefully not too far along that she can't fly back. She could potentially incur overstay ban as well as a very expensive birth.
