APPROVED, ALREADY IN USA BUT FIANCE BROKE UP

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

She could not get a K1 and be underage, wonder what her plan was coming to the US? To live off child benefit?

I don't know, but I'm gonna give her the benefit of the doubt, that is she came with the hope of finding this guy and reconciliation. It's a possibility.

It sounds like your fiance broke up with you, and you still chose to come to the country and wanted to sue him for breaking up with you?   That is not a thing.  Engagement is not a legal status of relationship.   

 

You can apply for child support, but then he has the right to get a DNA test to prove if the kid is his.  You will still not be able to stay in America, regardless of that.  The baby will be a US citizen but it still will not give you the right to stay here.  

 

I would book a ticket home, and call it a day. 

 

Are the Adoptive parents going to adopt YOUR baby?!  Is that what you mean?

Agreed.  I’m really leaning towards they are very young adults, and perhaps he lives at home and surprised his parents with news of a soon-arriving foreign fiancé.  I can tell you, as a 30-year old when I got my K1, I would not have come over if contact was lost with my fiancé.  

 

Curious though, where she’s staying?  Or surviving?

Per her post she is living with her soon-to-be adoptive parents. She is already referring to them as parents. Not sure how the adoption works for an adult person.

Fiance visa is a single entry. Like others have stated, you need to leave before your 90 days have ended. 

It sucks that this has happened to you but there must be some reason why your fiance spent the money to file for you only to withdraw himself from the situation.....

That could mean anything. My biological Mom still refers to my host family as "adoptive". I came as a J1 exchange visitor many many moons ago and stayed one year in an American host family, who was a lesbian couple. That was one interesting year.

Timeline

Try and find this man while you are here and try to reconcile. I can imagine you don’t want to live in a different country to the father of your child. Try reconcile with this man and ask him to be reasonable with the situation (both of you) created! 

 

It will be difficult for you to claim child support from a different country. I am guessing you hopped on the flight because you thought there was still hope. Give it a good shot atleast so when you fly back to your home country you know you tired and that one day you can tell your child you tried your best when you have to explain this situation in the years to come.

Very true.  My parents had an international student once, and some of the terminology used was incorrect to my ear. English is a difficult language (for me too, and it’s my first one) so sometimes words or phrases are used interchangeably, in error, but the general jist is the same.  

 

Unless adults can be adopted... in which case, I need to have a billionaire and his wife take on a slight used, but still shiny 33 year old princess without a crown ;)
