I'm slightly terrified that they were willing to lie to get what they want.  I hope they realize that him telling border officials that he was there to visit friends, when it's now clear he was trying to visit his wife and adjust, has been recorded.  And that that has established your friend as a dishonest individual who will need to be subject to far greater scrutiny than other applicants.

 

I wish them luck.  I also wish them the gift of honesty.

I was shocked when she told me he told the officer he was returning to see friends. THATS WHAT I TOLD HER. Its now been recorded. He never said Im headed back to my wife. Thats where they made a mistake. Afterall it is DHS. I cant wait to see this outcome.. Thank you for the feedback. I definitely want to share everyones feedback with her so he doesnt go the B1 route.

In this case, I would apply for the I130 first, getting that in the system showing they intend to do things properly, then have him try applying for a B2 so he can potentially visit during the process.  Now I am not saying he will be a shoe in for a B2 with an I130 processing, but if I were a CO, to me it would look better.

This is correct. I think thats where they are getting confused. They think he can come and go as a B1 while married and before adjusting. Basically he wanted to go home, pack up, say bye, and get back THEN adjust. He figured last 5 years he's been going and coming no biggie but this time he got stopped because he was approaching the end of 5 months of his 6 month visa and no return ticket....just a one way back to USA. Just when they thought he can get that one last visit, boom. You cant outsmart them.

VERY bad planning. As I said earlier I wish I had a clue or knew he planned on going back home. I was shocked esp being that she has been asking me about what forms to download for AOS, etc. Im going through my own K1 so I didnt mind helping. He has a home in his country and can work for his dad at his dads business. He wont be there for his childs birth sadly.

I wish your cousin lots of luck. Long distance relationships are hard enough without throwing becoming (effectively) a single parent of a new baby into the mix. It’s going to be a really tough year or so for her, I’d guess.

100% on point.....they thought this was the best way of cutting the line AT THIS POINT knowing he should have done I130.  

 

His travel could have waited imo. 

 

Yes technically his B1 Visa was still good. Thats probably how they saw it. Why waste a perfectly good visa. Let me go do what I need to do and get it out of the way and then head back home and adjust. Thats what he thought to do but didn't ever think DHS would catch the fact he had no return ticket back  ✈️

They are stupidly wasting their time.  The chances of his getting another B1/B2 are slim......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And he’s been pretty ..l tried to be diplomatic but dumb is the only word that springs to mind... in the big scheme of things. Spouses of USCs get forgiven a lot...if they are physically in the US. If they are not, it’s a much bigger problem. It’s entirely possible that if he does lie about his marriage to try get a B visa he’ll get a misrep ban, as that would be in writing on the DS160 and intent to mislead to get a visa easily provable. I’m sure it will be waiverable, but could add another year or so and legal fees to the process.  Two years apart, with new baby, is a lot for a couple who apparently never intended a long distance relationship.
