Broke up after received NOA-1, can it cause the problem for future fiancee's tourist visa

Hi, guys! Couldn't find a question like that so will ask.

Me and my ex-fiance sended a petition for k1-visa in Jan 2019. Received NOA-1 and in a 4 months after received a letter that our case was transferred to another office.

A week ago he received the invitation to do a biometrics(had a serious crime as now I know), but we broke up few days ago and he will not go and do the biometrics ofc.

 

I asked him to close the petition, he said he will not do that and will just forget about it.

 

Will it cause a problems for me in a future if I will ever want to visit USA as a tourist or for studying, I mean, problems to get a visa? Should I notice that I had a fiance who sended a petition for me and we broke up in the past when I will try to get a tourist visa?

Does K1 petition has an expiration date or he still should close it anyway?

it may affect future visitor or student visa application as the petition (whether left alone or withdrawn) shows you had some intent to immigrate.

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

why was the petitioner asked to do biometrics? that is not normal.

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

Because of his crime. I’m guessing when the case was transferred, it was transferred to Vermont.

must have been quite the crime or a vawa issue. goodness. not sure id want to be involved with that anyways. 

 

the petition will die on its own but it may cause issues in the future if he doesnt withdraw it. op can write uscis and explain the circumstances, but only the petitioner can actually cancel the petition. if you do apply for any type of visa in the future. you can explain at the interview and hope for the best.

sadly but he will not cancel it, maybe just playing on my nerves, have nothing to do with it

Also were reading that beneficiaries sended a letters to uscis that they broke up with petitioner but I wonder if uscis really care

There’s nothing you can do as the petition is all about the petitioner. If he doesn’t attend the appointment (what does he have to hide? Sounds like his record might be more extensive than he told you) then the petition will be denied.

YOu can send one, and should in my opinion (in the off chance it at least gets tossed into the file), but it will NOT cancel the petition. only the petitioner can cancel it.

Agreed. We don't know what OP knows but why the secrecy? Why the flat our denial to attend biometrics? why did you two break up?

What's a i129f petition expiration period if he will not withdraw?

depends on where it is in the process. 

 

several months. 

 

our cancellation took about 4 months for the k1 after we married and that was with me sending a withdrawal letter. we were much further along in the process than you, as well

This petition will affect you in future, you have an intent to immigate so to get a tourist visa you wiil need strong ties to tour country.

Each time you apply for any jind of visa you need mention tgat petition on the form.

Only petitioner can close the case, but as you say he was asked for biometric, that mean ge needs send that biometric to uscis or go there, maybe they give him a timeline and ge doesnt do it maybe the case is close.

When you have a case and you fail send information to uscis thay close the case.

K1 2017

Aos sent April 2018

Aos interview July 2018

Work permit September2018

Aos approved July 24, 2019.

Roc April 27, 2021

Biometric reused june 28, 2021

N-400 online April 27, 2022 base on 3 years rule, biometric reused.

N-400 interview on December 12, 2022 combo interview i-751. Approved.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

January 13, 2023 apply for us passport.( regular service).
