Adjustment of Status Interview - financial sponsor

Hey guys, 

So, I looked at the case status today. We have the visa interview scheduled, still to receive notice in mail. A little history, we did fiance visa last year and my fiance was here in September last year. We got married in November and applied for his green card. I did work at the time, however, due to school and stuff, I decided to stop working in March of 2019. I didn't make enough in last year to file taxes, so I didn't file taxes. My fiance has been working since he got his work permit and has been making a little over $3000 a month. Now, since we don't have last year's tax return to show as proof of income, can we just show my Fiance's pay stubs as proof that he is making enough or should I have my sister who doesn't live with us, fill out the I-864. Please help!!

since you're unemployed you will need a new i864 for the interview and a joint sponsor, your husband's income is irrelevant, 

 

remember, he's not your fiancé anymore, you married him so he is now your husband, you will need a joint sponsor now

HI, thank you for your response. My sister, lives in California. She makes enough to sponsor him. So, I understand a new I-864 is needed. Do I have to fill out one myself also, or only have my sister and her husband fill out one? Do they have to do separate forms or one form is enough since they filed joint tax return?

Hi, 

Thank you so much. I really appreciate your help. Any other things I should know or any other suggestions that I may have missed to ask about? I am currently in Nursing school, so working while in a very fast paced Master's Program proved difficult, so I quit my job once my husband got his work permit and he started working. I assumed, he could show his income as a proof, I had read that somewhere. But, to be on the safe side, I also asked my sister. I am glad I asked this to the visa journey community. This page has been a great help. I thank each and everyone of you for all that you do. Thank you.
