But you survived. I survived. We all survived. It was hard. It is hard. But it can be done.

Absolutely it can be done. But there’s also a reality for many people that is very complicated. So it doesn’t work for everyone. I only speak for myself of course!

When did you apply for his EAD/AP? At the same time as the adjustment of status?

Yes. March 14th for all three.

His father is very ill.

I would suggest that you focus on his father's illness and take lots of documentation from doctors, hospitals, sworn statements from his father or family members verifying the illness.  From the expedites I have seen here on VJ during the last year, medical documentation seems to have a chance of approval.  See if you can put something together, you still have time before the August trip to collect some medical documents.  That would be a more likely path to an expedite approval for AP than the family event that has been planned for a long time.  He needs to see his father because he is very ill.  Doctors can write letters, there may be medical bills or records you can get and take to USCIS and plead your case.  That's what I would do in your situation.  Documents, documents, evidence, paperwork, statements, letters, bills, photos, anything you can get copies of that show his father is very ill.  I wish you all the best and hope that he can get the AP expedited.

I'm confused.  Are you surprised that he doesn't have his combo card yet?  My husband's took 3.5 months from biometrics, and we were just about the first in the November 2018 AOS filing group here to get it.  Some are still waiting.

This is the downfall of the K-1 vs the CR-1.

I was thinking the same thing, how did this come as a surprise when processing times were somewhere between 6-7 months for AP/EAD back in March when they filed?

I don't see an expedite being approved for a vacation. Outside chance if a close relative is seriously (life-threateningly) ill and you have documentation of this, but it's far from a guarantee.

As someone stated above, this is one of the pitfalls of a K-1 over a CR-1.

You probably should go with him and plead to them about being older and if he can’t go it will end your relationship and all that good stuff

I’m confused - do you really think this would help their case?

I’d be concerned that if you went there and said he needs an expedite because if he goes and we have to wait another couple of years, we’re splitting up because I won’t wait for him...that they’d be less likely to give one, as it might make them question how important/genuine a relationship it is, if you’re already planning a breakup when hit by an obstacle...?

OP - please note, I’m not questioning your relationship integrity or anything like that, just saying how I’d imagine USCIS might look at it. I personally wouldn’t give that reason, nor the family event reason. Only thing I’d talk about would be his father’s illness - but I think it really depends on how ill he is and what his prognosis is.

Are there any options!?!? If not, he will leave and our relationship will sadly be over :(

there are larger issues at play here than perhaps having to refile for a cr1 and wait another couple of years.

we are older too, and if we had to, yes, we would both wait more time. Did it once, could do it again. would it suck? YES. is it do-able? absolutely. just as i would move to canada if that was our only option.

anyways, your family reunion will not constitute an emergency. medical condition, maybe if you phrase everything perfect and send medical prognosis/diagnosis. even then, it will take a month from initial expedite request to receiving the card in the mail.

i 485, 130, EAD and AP

Our GC application has been “ready to be scheduled for interview” for two months now so who knows when that will happen. In the meantime, my husband needs to go home to Ireland at the end of August for a years-in-the-making giant family event (plus his sister’s wedding). He has his plane ticket already and we never thought end of August 2019 would be an issue (field k1 Feb 2018!!) to at least have AP approved. But now I think it’s unlikely to happen (was beginning of July on VJ estimate when we first filed...now end of September). So what to do? His father is very ill. He could be back in hospital at any time. It’s all just so stressful! I see how to expedite EAD. We do not have a financial hardship with him not working so I don’t see how that would work. Are there any options!?!? If not, he will leave and our relationship will sadly be over :(

My mom had to ask for an emergency AP when she was waiting on her citizenship.

My grandmother in Korea had stage 4 cancer. My mother went to say her final goodbyes to her mother. Once she received her passport, she was able to attend the funeral.

So maybe ask if they can do it because the father is ill versus having to attend a family get together.

You don't need an AP when you're waiting for citizenship.

Just to clarify, the Philadelphia office doesn’t accept walk ins. You’ll need to call the number listed in the link and explain why you need an appointment (AP to see unwell father). They will then arrange an appointment for you.
