Is it possible to just expedite AP?

Our GC application has been “ready to be scheduled for interview” for two months now so who knows when that will happen. In the meantime, my husband needs to go home to Ireland at the end of August for a years-in-the-making giant family event (plus his sister’s wedding). He has his plane ticket already and we never thought end of August 2019 would be an issue (field k1 Feb 2018!!) to at least have AP approved. But now I think it’s unlikely to happen (was beginning of July on VJ estimate when we first filed...now end of September). So what to do? His father is very ill. He could be back in hospital at any time. It’s all just so stressful! I see how to expedite EAD. We do not have a financial hardship with him not working so I don’t see how that would work. Are there any options!?!? If not, he will leave and our relationship will sadly be over :(

He can go to a USCIS office and request emergency AP.....but there are no guarantees.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I doubt USCIS will consider a family trip as an emergency.....

K1 process is one thing. AoS is totally a different thing. AoS is a black hole that operates on uncertainty instead of logic. It's unfortunate but it's common to expect missing important events and to not be able to leave the US for a long while during AoS. They MIGHT give him emergency AP but most likely they will not. A family event isn't an emergency. And if it was so important for him to travel out of the US within a year or so after entry, the official may ask why you guys did not do a CR1/IR1 visa, which would have given him permanent resident status upon entry.

 

And if your husband leaves, why would your relationship be over? It'll be tough but you guys could start over with a spousal visa. You can still go with him to this family event too.

Wow...if he leaves your relationship is sadly over?  If that is truly the case, it is indeed a sad relationship.  Sorry, but I get the impression you are so frustrated that you are overexaggerating.  I cannot comprehend a family event being more important than a husband/wife relationship.  You still have time so hopefully AP/EAD will occur before his scheduled family event.  Wishing you good luck!

It’s not a sad relationship lol. I’m just not interested in being married to someone who lives in another country for 1-2 years while we start this all again. We already had a relationship for years in two different counties tries and that was hard enough. He would like to get back to working on his career and be able to put down roots...not spend another 1+ years living in limbo.  This has already been years of chaos...we are older, have both already been married, have our own kids and our own lives. I suppose it would be different if we were young and in love, thinking this was “meant to be” lol. But, for us, we have real lives that take priority. Yes, we love each other obviously and we will try to stay together but I think it is unlikely and we will agree to stay great friends and move on if he has to leave and cannot come back. 

 

Its just frustrating that he can’t just get the AP. Happy to wait our turn for the EAD and then GC. But one freaking trip to see his father and entire extended family. A once in a lifetime gathering. Potentially the last time he sees his father ever. 

 

We did not do a spousal visa because we were not ready to be married back then. It just wasn’t time for us in Feb 2018. Oh well!

Hey, I'm from N Ireland!!

 

I understand the frustrations and the limitations to K1 like many. It breaks my heart especially for some of my Nov 2018 buddies who are still waiting for an approval of something. I really get how important it is for your significant other but VJ members do advocate nothing should really be booked without an approval (to avoid losing money)! It may be worth expediting but again there's no guarantees. We all have real lives that take priority but the K1 route does have its disadvantages I guess. I have a trip booked in August which will be the first time; making it about 10 months since being here-it took some gritting my teeth to get through 'the wait'- I came here on K1 on 10/10/18. To date, I only have my EAD/AP and the GC interview may come late this year if I'm lucky lol.

Oh of course there are no guarantees. We didn’t actually “book” this. It is the return trip from his trip here in February. The return trip was half the price of the one way ticket! To be honest, when we filed the K1 in Feb 2018, everyone seemed to be getting approved in 6 months. We were ready each step of the way and we seemed to be the SLOWEST in our group each step of the way. Got an RFE for a missing item that was actually in the application, for example. So we just never thought end of August 2019 would be an issue. Oh well! We have tried so hard to make this work. But this long distance thing is HARD!! Sounds like there’s nothing to do but wait and assume it’s not going to happen.  This is a horrible way to try to have a relationship!

I would try to make an appointment at the local office and plead you case to a real person. You might get it

I think he will do that. Why not? Seems there’s nothing to lose. How do we find the local office? Is that where he will go for the interview?

Look on the USCIS website and see which office is responsible for your home town.
