Which visa will my wife get.

I've 2 questions. 

So I'm in the process to submit all my finical documents to NVC so they can schedule my wife appointment. Our 2 years anniversary is also approaching and I notice on homeland secretary Affidavit part, her visa class is cr1. So my questions are 

Will it change to ir1 when she reaches to the interview part? (our 2years anniversary is this Monday and I'm waiting until our anniversary to pay the immigrant fee and affidavit fee ) Or will she have to ask for it to change at the interview ?

IR1 or CR1 is determined at the time the person becomes permanent resident. If at that time, it’s more than 2 years since your become legally marriage, it’s IR1.

She becomes the permanent resident the day she enters the US on the immigrant visa.

More specifically, the visa class should be determined before they issue the visa. The status will depend on the date of entry into the US on the immigrant visa.

The status is what actually matters. The visa is just a paper.

Yeah, don’t worry about the visa classification. Even if she gets CR-1, if she enters US after 2nd anniversary, she will get the 10 yr GC.

 

i hope you aren’t waiting for month/s for your anniversary to start NVC process. If so, you are just delaying your case yourself.

@arken actually no. The fees and I've to move (very costly) so I'm waiting until I move (12th of next month) then I file (hopes that's not too late) but yes we will be in our 2yrs when enter the us. So they will give her without asking then

I just got the NVC letter and Monday coming  is our 2years anniversary

Not delaying 😔😔 I'm moving and the fees are a lot 😔😔 you don't think filing early next month is too late?

You can pay today or next week or next month or next year and so on.

If they wait more than a year the caveat is to contact NVC about every 12 months to avoid them sending the I-130 back to USCIS.
