K1 Visa - Process more than a year - DELAYED

Guys please share your thought!

Our immigration lawyer in San Diego filed our K1 last end of May 2018, out of her negligence we received 3 RFE's - we sent the 3 documents needed in November 18. From that moment, I'm constantly checking my USCIS account if there's any movement to our petition since we lost our faith/trust to our lawyer.

Also, I was the one who informed our lawyer that our case is outside normal processing - finally she sent the request to USCIS 3x and we received the same response, its being adjudicated. Our lawyer sought assistance from AILA but there's no luck, they can't do anything.

I've read in this portal that you can approach USCIS Ombudsman so again I suggested that to our lawyer and she send inquiry but until now we are still in dark tunnel without any glare of dim light.

 

To the fact that our son is US Citizen too, we couldn't think for any possible reason why it takes over a year now. We are beyond frustrated waiting for so long and our lawyer couldn't do anything too.

 😭Staying uplift but this take much of our time. It's been more than a year now we haven't the NOA2 😭

I'm sorry to hear of the long wait - it can really get to you!

 

You mentioned 3 RFE's - did you confirm USCIS received the requested evidence? What were they for?

 

Have you sent in inquiries through USCIS as your case is out of normal processing times? If so, what was their response?

 

You can also contact your local senator's office and they can do a congressional inquiry (it can take a couple of months to get a response).

 

From someone who has waited an extremely long time for their NOA2, all you can do is inquire and go through the appropriate channels available for you and wait - they will give you an answer eventually, but unfortunately it's on their clock.

Did you receive 3 separate RFE's or just one asking for 3 different things?  

The wait is maddening, and I can imagine more so with a child involved.  I am so sorry and hope that you can find answers soon as well as peace of heart and mind as you wait for a hopefully positive outcome!

Thanks for your kind thought and suggestion. Yes, our laywer sent inquiry 3x to USCIS  but they have the same answer.

 

USCIS sent me notification that they received the RFE's documents. Our lawyer sought from USCIS Ombudsman last week and awaiting for their answer. However I'll keep an open eye to another option.

Yep, we received 3 RFE's documents that our amazing lawyer forgot. Easy to forgive not to forget, she's amazing lawyer👿

 

And yes, our son coudn't make it on time this school year. Thanks for being compassionate!

Fingers crossed you get an expeditious and positive answer.

 

Lawyers are SO frustrating and (in my opinion) a waste of money most of the time for these things - I don’t think they are really vested in the cases they take, money is what they care about. If I were you, I’d stop utilizing the lawyer and start an open line of communication with the necessary avenues yourself.

 

In our case, we were THIS CLOSE to filing a Writ of Mandamus - and spent a ridiculous amount of money. They did nothing.

 

We were approved shortly after reaching out to the senators office who facilitated a congressional inquiry - which produced an RFE which led to our subsequent approval.

 

I’ve received the most beneficial information right here, on VJ. In hindsight, I would have gladly handed over my money to @Greenbaum who has provided me (AND SO MANY PPL) with the most useful, experienced advise rather than to a high powered immigration attorney who just saw me as a cash cow.

You're absolutely right, I felt like I'm the one who's feeding the information to our lawyer and she's just execute what she been told - it's frustrating.

 

Taking every possible options than can make our petition move ahead.  Merci Beaucoup

I've known others that have fired their lawyer.  This is a decision you may want consider.

Another reason not to use a lawyer.  Drawing the process out can equal more money for them.

 

No one is more invested in this process than the petitioner and beneficiary.

Well exactly.  That is all they can do.  You have to provide the info and the documents, and all they can do is submit them.  Lawyers have no "in" at USCIS or DOS.  They cannot speed up the process or affect a decision.

Agree. They cannot speed up the process, but their inactivity or their misstep can adversely affect a decision. :o

I wish we didn't hired her, the stories that we were told was a total BS + a waste of money.

 

Till now there's no movement in our petition.

She isn't an amazing lawyer if you've already had 3 rfe's.

 

If it were me, I'd ditch the lawyer and DIY. The majority of us here have very successfully with the help of others from this site.

Fire the lawyer.

 

There is no need for one for the overwhelming majority of people.

 

Contact your sentators office. Send them the requested information. Take the lawyer out of the loop and stop giving them money.

9/15/22 APPROVED! Now to wait for NVC and interview....
