The beneficiary is looked into primarily after submitting the DS160, at interview stage...so it would be at interview stage (or the AP afterwards) where problems would arise, if they were going to...

oo yes sorr y I got confused my partner the petitioner had a check on  1129f  I had the check for my interview. its getting late so my mind is muddled

The I-129 form was all about the Petitioner (me) and not him. We filled out the ESTA long before we tried for a visa which is why we didn't know, we never did the research and know what we know now. He knew he had something but couldn't remember so before even filing out for the ESTA, we ordered his basic police certificate (he was applying for job and had to have one) and it came back as 'none recorded' under warnings, cautions, and convictions. It wasn't until his second trip over after reading in one of the forums that I realized we shouldn't have used it and we haven't since we found out. (And of course by that time, we order the police certificate for immigration that shows everything)

But yes, being away is super hard!
