NVC can't find our petition

Thanks again for all the information. I just got off the phone with USCIS. The T1 rep confirmed that as the petition is 90+ days overdue they will be able to take action. She filled out a "service request" which I'm sure is total bogus, and mentioned that the T2 line stopped accepting transfers a few hours ago - apparently typical for Mondays, and suggested calling back tomorrow first thing in the morning and putting in a request for a T2 callback. Not sure if bogus or not. The new USCIS menu is a nightmare - took me almost 10 minutes before I got put on hold, and then waited on hold for another 30 minutes 😡 before the phone was picked up.

Hi, pls do you mind sharing what eventually happened to ur case after you spoke with the tier 1? Our case got approved aug 12. That's 72 days ago and nvc has still not received it. I am starting to get worried about it and dont know if i should be calling uscis now or wait till 90days. The 90 days wait with no clue of what's going on feels like i am being tortured. I mean why approve the cases and hold on to it for 90days when some cases get sent within 2/3 weeks?

NVC finally received the petition about 3.5 months after it was approved. The Tier 1/Tier 2 service requests AFAIK were useless. If you call USCIS now they'll probably tell you to wait until the 90 day mark but it can't hurt to try. Honestly being stuck between USCIS and NVC has to be the absolute worst place in immigration - if you call USCIS they'll tell you to keep waiting, even if you're petition is way behind schedule. Or they'll fill out a useless service request and now you need to wait 30 days before contacting them again. If you call NVC they'll tell you to call USCIS.  Congressmen/ombudsman seem to be hit-or-miss as well. There's very little recourse.

 

However, our I130 was approved at a field office (not a service center - special circumstances) and later I found out that field offices tend to be very slow with sending things to NVC since they don't do this regularly. I'd be much more worried if it got stuck at a service center since those should (hypothetically) be well-oiled machines when it comes to processing and shipping I-130s. 

 

You can always call USCIS and give it a shot, and call NVC at least once a week to see if the petition is at least in their building.

Have you put a congressional inquiry with your congressperson or your senator? If you haven't , you totally should asap, preferably with both.  That's how we got progress, USCIS /NVC inquiries were useless. Ombudsman never even bothered to return an email, so her office was also no use in our case.

 

 After your congress person's office  puts an inquiry with the Immigration Liason, who is specifically assigned to answer congressional inquiries, USCIS now has to  answer in a reasonable timeframe, 36 or 72 hours, can't remember which. That's how the petition moves to the Field Office. In our case, h/she "thoroughly" re-reviewed our petition then sent it to NVC in about 10 days, amounted to 139 days in total.

We did also wait for 90 days to fill out privacy release forms with their offices, which also I figured was unnecessary in hindsight,  they take a week or a month depending on the office and state. my thoughts to you would be to fill out those forms ASAP, don't wait for 90 days.

So we called the USCIS before, and they put in a service request basically saying they are looking for the approved petition.

We had to wait until 90 days had passed, and when we finally called and got a hold of a supervisor, they were finally being super nice and helpful to us.

They recreated the case, and sent it out, I think 2 days after, and it was received pretty fast at NVC.

We also requested our Embassy to expedite our case, with the following reason that the USCIS had extremely delayed our case, and then two other reasons, and we got it approved. Don't know what the reason was that they accepted the request, but maybe because of the USCIS thing.

Thanks all for the responses. So i reached out to my senator for whatever it is worth. I was told it might take a month before they get a meaningful response from uscis. I will start calling uscis as from after 90days post approval. Hopefully i make progress before i get to 90days. It's so frustrating.

I just got my case number today, so you should expect yours in around a month.
