Establishing domicile being out of US for most of year

Hi,

 

A family member recently got the ok to proceed through the NVC documentation process after waiting for 10+ years requesting her adult son for the green card.

 

She is a US Citizen recently retired mother who's been spending most of her time in recent years abroad to be with a sick family member (in DR) but travelling back and forth to the US. She is petitioning for her adult son for a green card with a co-sponsor (to meet the income requirement). In the last few years she's only stayed at most a month or 2 per year in the US. Given this, we had a few questions and would appreciate any input please:

 

1. Should she come to the US before the application materials are even submitted through NVC?

 

2. For establishment of US Domicile purposes would the following be sufficient for her:

 

- Voter registration documents

- Taxes for last few years

- State issued ID

- Social security card

- Medicare proof

- Medicaid proof

- Bank statement

- Cellphone bills

When does she intend moving back to the US?

 

Did not know you could get Medicaid is you were not a State resident btw.
