In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That's what I'm saying, and that intent alone got her denied, I assume? I keep hearing on VJ that intent alone isn't enough to get denied.

OP essentially ADMITTED that she lied at POE.

 

of course she got a NOID.

 

Plenty of people do adjust from a vwp but in our case, we had our NOA2 and were a couple of months from interview, when he came 'home' for xmas and we decided to marry. asked me abot a week before xmas what i wanted and i said to get married. so .. it happend xmas eve in our home, was lucky a friend of ours is a pastor and had the time to do it, my brother and sister were going to be there anyways. no wedding dress. a red xmas dress is what i wore LOL . not to mention the wedding plans for july (Which still stand only now its a party wedding and not a real wedding LOL)

 

and the fact they had a kid and got pregnant SOOOO quick after her arrival in US - who knows they are pregnant at 3 weeks?? thats weird but ok.  i mean all of that really doesnt look good. had they even filed for a K1?

 

so many questions.

not usually, and its determined at poe, but if you go back and say ' yeah , well, we knew i was going to stay' - thats a WHOLE other ballgame

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

relationship was genuine... 

Having kids just proves you had sex.  You can do that with anyone.  I despise this argument so much bc it isn’t sensible.  

 

Not to say those that have children aren’t in real relationships, but it’s not the key indicator.  Especially when there are couples who want to have children but cannot, for whatever reason.  A childless relationship isn’t any less real.

I don't think that's another ballgame at all. No matter what was said at POE she was still let into the country, and later denied for having intent to stay and adjust. Had she lied about something significant I can see USCIS denying her, but this is all about her intent. And only intent. Intent hasn't been an issue in the past, no matter what was said at POE. And CBP determined she had no intent and let her in. This is the first time I have heard of it, are they getting tougher with people who try this route now?

He said she got pregnant 3 weeks after she arrived. And she arrived in February so she would definitely know by now. Not that it matters. Most married couples have sex. And most fertile people become pregnant as a result of that. It’s hardly earth-shattering that a married woman became pregnant after spending 3 weeks with her husband. How else did we all come into being? 

the way i read it was she knew after 3 weeks she was pregnant. i dont care any more about that baby than uscis does lol i also think there has to be other issues or reasons for the noid. something she said or did or something..

i dunno admitting you lied is a BIGGIE. adjusting from a vwp is allowed, intent is determined at the border but if she told POE one thing then told her interviewer something contradictory - it makes sense they would scrutinize everything about their case more closely
