Interesting. So what’s the story? She intended to go back? She had a job to return to? A home? A car? Financial commitments? Which VWP country is she from?

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

she is from sweden she was not working at the time she came here

I think you need a lawyer and get a hearing.  Procedurally there may be another appeal level (I’m not sure of the steps at this point) but it sounds like they have two sets of statements from her a few months apart that contradicted each other.

 

But this is something you need professional advice on.

she is not originally from sweden.

I don't know your specific community (maybe Somali?), but you really need an immigration lawyer and a translator. He or she will build a case for you that there was no intent to adjust status. Make sure that your wife has someone there going forward, so that she is not misunderstood.

You will need a lawyer to help you. I think the biggest question is why all of a sudden the plans changed from just visiting on the VWP to adjusting status? And that the answer to that might hold the solution. Getting pregnant on the trip would not be a reason as many people here have overseas spouses that are pregnant.

 

But honestly, you have to admit that the situation looks like intent from the start..

the letter says you entered united states under the visa waiver program feb 8 at that time you were interviewed by costoms agent and border agent. you told the agent you had no plans of moving to the usa. the agent contacted your spouse who stated there were no plans for you to move to usa. on march 15 you filled form i 485 and appread for an interview on june 5  during the interview you stated your purpose of traveling to usa was to live  with your husband and child. you testimony indicates that you had no intention of returning to your home country furthermore your failure to disclose your true intent at the time of your entry to the usa curtailed additional questioning for determining eligiblity as result of you are in admissible to the usa
