Hi everyone, my husband gonna be the joint sponsor for my friend, so he has to file form I-864. But we file tax jointly then I have to file I-864A as well. I have several questions regarding to form I-864 & I-864A:

 

On form I-864 part 6:

1. For "current individual income" and "current annual household income", do you put the 2018 income or the estimate 2019 income?

2. And if you use 2018 income, this is the exact number based on W-2 right? And it will be different from the number on our 2018 tax income (after tax), which is number 24.a

3. Since we filed tax jointly, does my husband put me down in number 8 which is "income from any other person who was counted in household size"? 

 

On form I-864A part 4:

4. What should I put for  the tax income for the last 3 year, which is Part 4, number 2.a-c? Do I put the same number on our tax return as my husband's I-864 or we have to separate the income? 

5. Do I have to submit copy of my GC? My GC is expired and I am currently in Removal of Condition on GC.

I am so confused.

Pulled from the i-864 instructions for item 7. Current individual annual income. "You may include evidence supporting your claim about your expected income for the current year if you believe that 
submitting this evidence will help you establish ability to maintain sufficient income". 

 

For my husband's AOS I included my expected 2019 income. My expected 2019 income is more than 125% of the poverty line for our family size, so I didn't have to include any extra info for family expected annual income since I didn't need any supplemental support. 

 

I'd use my gross w2 income, not the post tax income: "For purposes of this affidavit, the line for Total Income on IRS Forms 1040 and 1040A will be considered when 
determining income. For persons filing IRS Form 1040 EZ, the line for adjusted gross income will be considered." (I don't have my taxes in front of me but I imagine off that wording total income is pre tax). That being said:  "Do not leave the boxes for Item Number 24.a. blank. Type or print the most recent tax year and your total 
income for that most recent tax year. If the amount was zero, type or print “zero” or if you were not required to file a 
Federal income tax return type or print “N/A” for not application"

 

Not 100% confident answering #3 or the i-864a questions since I didn't file an 864a. Sorry!
