I-94 expiring

I have been trying to apply for a Kansas driving permit.  The law states that I can have one on a K1 Visa while waiting for AOS. However,  the officer at the DMV says they can't issue one for me because my I-94 as well as the stamp on my passport expires on 26th June, three months after my entry date.  We submitted a copy of our marriage certificate to show that we were married within the three months.  She suggested that we have my I94 extended.  No idea how to do that and we are very frustrated.  Any pointers on this?

They are right, by the time they process it and mail you the permit, your i94 would’ve expired, that’s why they don’t issue permits or DL or SSN that late.

You can apply for it once you receive your EAD or GC whichever is received sooner.

Looks like you'll have to wait until you get your EAD.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It would have expired along with your I-94 after 90 days in the US anyway.......You'll now need an EAD or Green Card.

Thank you for your help.  I guess I have to wait then. It's a lucky thing then that I am allowed to drive on my country's driving permit for a year

You may want to check on that as well. Typically that only applies to visitors, not those on a K-1 visa / AOS applicants. Once you become a resident of the state (different than your immigration status!), you need to use their license.

That's not true. A foreign driver's license is only valid to be used with a tourist Visa.

This is common for K1s though. There are few states that allow extensions on temporary DLs. Most of them will expire at Day 90 and we all just go without driving the 6.5 to 8.5 months until EAD is approved.

It's just one of the pitfalls of the K1 visa. A Spousal Visa would have been a better option if you were required to drive.

Only if the clerks at the DMV recognize the endorsed visa as a temporary I551 as not every IV entrant gets their physical GCs within 90 days.

Kind of a stretch since you're in Lawrence, but is your spouse's lease almost up soon to where you could move to the Missouri side of KC? Missouri allows temporary driving permits. They are valid for 60 days at a time and can be renewed as many times as needed. We emailed the DMV directly to get this information as none of it was face up on MODor's website.
