But the big problem are all the employers who don't even ask for papers.

But you do need a ssn to get a job anywhere..and if you are illegal..you have to provide the documentation to the people at the social security office in order to get it....

If you didn't have papers and I decided I didn't care and let you work for me, and paid you cash at the end of the day, who's gonna stop me? Plenty of illegals work in this manner.

Also....if there are fake ssn out there...where does the tax witheld at source of pay go to and what happens at income tax time? I don't know how they manage to do it.

Yes, there are fake ssn's out there. The SSA actually has a fund of money that it gets that can't be traced back to a valid SSN. I heard this on MSNBC, I don't remember what the fund is called.

now.. what kind of evidence would USCIS accept?? I mean.. would ur neighbor come to the door and say 'hey, how u doin, u know.. amh.. are u an illegal? may I see your green card?'.. rather than that stupid example, I cant see other way of people (not employers) asking for evidence of legal statuts

If a USCIS rat-line existed, I think most of the reports would be based on hearsay.

Doesn't matter. It only takes a few seconds to check a name and address against a database.

In theory you would think, first time the employer pays the quarterly taxes the employee's SS number would come back wrong. However, if the illegal is determined to not be caught, there are ways around this. They can use a valid ss # that as agent smith said can't be traced back to a person (either a deceased person's number or something like that. It takes the SSA time to "retire" all those numbers).

As far as how hard is it to get a driver's license without an ID. Not really hard at all. In some states all you need is a piece of mail with the name and address on it, and one other piece of ID like a paystub. A social security card now is a must as well in some states. I know that state ID's are obtained that way all the time by minors using their older friends or siblings info to go get ID that makes them older (and that ID will have valid info on it, but it won't be the person who is using it).

In this day and age of computer technology, there should be some way the employer can type in the A number or something and get a report from USCIS. Maybe give them the pic (since everything is digital) and expiration dates of the documents and verify they are accurate and valid. You know they have it all computerized anyway, if they made it available to employers they could do away with the fraud part of it.

Of course, if an employer is determined to hire an illegal, they will do so without checking.

At this point, you don't have to have a SS # to work. You can work if you have an ITIN number. It is the same format as a social and you can use it to file taxes. That's how they work and pay taxes without a social and without being paid cash.

No, you can't. Not legally. The ITIN is for individuals not eligible for a SSN (anyone authorized to work is eligible for a SSN) that may need to file a tax return for one reason or another. It is not there so you "can work". Look at the I-9 (page 3) for a list of acceptable documentation to establish one's eligibility to work. The ITIN is nowhere on that list. :no:

I didn't say it was there for the sole purpose to work. I said you could work if you have one. The reason for that is people, employers, don't realize that's not what it is for. There are plenty of people I know who are working by using an ITIN number because the employers don't realize they shouldn't be. I was just trying to point out how people work without having a SS #. Again, another point lost because all you all want to do is argue.

How can the employers not REALIZE that you can't use an ITIN number???

I have all our forms for employment right here on my desk. It says on each one "Valid Social Securiy number". The employer is responsible to check the documents provided to them for employment.

It's easy to not realize things when you don't want to realize them ;)

that's kinda my point. you'd have to be really stupid to claim accident on that one. The only employers that are letting their employees work on an ITIN number are the ones who don't care if it isn't legal.

Exactly. They don't care. Plus, they probably figure it is better to have some kind of documentation than none at all. That's just my opinion, I can't speak for them as I don't know why they really don't seem to care. It's cheap labor for one so that could be one good reason why they don't care.

Well considering almost every agricultural farm and construction company here is doing it, I would spend most of my time on the phone reporting people. Plus, how big of an ### would you have to be to destroy someone's business just because you have an issue with how they run it. Most of the companies here in this area employ illegal aliens, with or without documentation. I wouldn't put hundreds of businesses out of business just because I think I am higher and mightier than them. What would I benefit from it anyway? I could care less what they do with their businesses. It's their business, not mine.

So I assume you'd also be okay with a business that uses child labor? Or violence to harass and control workers? Or maybe you'd be all right with supervisors demanding sexual favors in exchange for job retention?

That's an incredibly specious argument.

I think from this last page or two of posts, it's clear that solving the illegal immigration problem needs to start with enforcing existing controls on employers and making it easier for honest employers to verify legal status of employees. And, barring that, shutting down businesses that intentionally or repeatedly flout immigration law.

Easy answer: illegal workers are ILLEGAL. It's not being an ### to report a company's illegal activities, it's a responsibility that we all hold in order to stop this massive problem we have in this country with illegal immigrants. It's your moral and ethical obligation to help stop the problem. And certainly anyone on this board who's immigration status is hanging by a thread should agree that the risk of being caught with the knowledge isn't worth the consequences?

It's ILLEGAL to withhold information of a crime. Aiding and abetting, obstruction of justice, call it what you want.

Not your business? How fair is it that we all had to wait our turns for our SO's to get their EAD's (or those on here that aren't the USC had to wait) while we struggled through it and others are out there working illegally?
