You also can post what your RFE is  and members here would be happy to help. They are also knowledgeable enough to know if you need a lawyer and will tell you.

Attached is the RFE I received.

Few things:

1) We don't have kids, so cant provide any documentation about that.

 

2) We were living in Austin until May 2016 and then we moved in with our in-laws. The house we live now is joint ownership of my husband and in-laws. Mortgage  and utilities everything comes in my father-in-laws name.

 

However I do have utilities and apartment insurance and move-out refund documents till May 2016.

 

I have emails and invoices for the roof and glass work done around house, or communication with home insurance people.

 

3) We have a joint checking account. I have medical, dental and vision insurance documents from all these years, through my husband's employer. I drive the family car and its has my name on it on insurance. I also have dependent confirmation document from my husband's employer.

 

We have only one loan and that is my student loan. We do not have any joint credit cards.

 

Importantly, my spouse has not been very cooperative of this whole I751 procedure. And he would not give any more documents either. We still live together its just he is like this. Also he has not filed our taxes since 2016, which could have been a major document.

Have the in-laws write up a document stating when you moved in and what the arrangement is. Or write it up yourself and have them sign it.

If they won't provide that, then go on to secondary evidence like bills/invoices, mail, employment?, etc.

This is kind of ringing some alarms...does he not want to be involved in the marriage or something? This is something IOs can and will hone in on if there is an interview.

 

Also, he didn't fail to file taxes. You failed to file taxes, as did he. One can always file their own taxes. Assuming one met the minimum income to be required to file, they have a legal duty to do so.

I'm not doubting somebody would probably owe more filing separately (MFJ usually has a lower tax liability than MFS), just pointing out that the duty to file taxes lies on each and every individual. It's never the fault of somebody else as to why your own taxes are not filed (barring possible guardianship or POA is involved).

If the IRS were to question it, "my spouse didn't file" would not end well. If you were to file for naturalization and still not file for those years, "my spouse didn't file" would not negate the requirement. If you were to petition somebody else for a green card, again it would not qualify.
