Hi all,

 

I am a US Citizen, planning to file GC for my parents. I know that I need to submit I130 to start the process, but should I need to be aware of any other quick process to follow if the parents are currently living in USA on a tourist visa?. I vaguely remember of something like doing AOS for the person who is living in USA while submitting I130 form. Please advise and thanks in advance.

 

Note: current stay of my parents is valid till Sept 8th 2019.

You can visit the US on a tourist visa, you can not live in the US on a tourist visa.

If you read that article, it says that there is no 90 day USCIS rule.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Submit the AOS packet as well as the I-130 and they can adjust in country since you can file an adjustment packet with I130 pending and a visa number is immediately available for parents of a USC.

 

If it's ethical or not to try and game the system this way, and what the officer will think of it at interview, is another question.
