“Our lawyer advised my wife not to revoke her legal status”. This is from the article. What is supposed to mean. You cant revoke your own legal status ?? Or did it mean to withdraw her AoS application ?

Probably a law who really didn't know what was going on.

Reporter who did this article hails from the same region in Kenya as the lady. I do not think you will get any truth.

I know these people. I will not be surprised if that Certificate of No impedance to Marry was obtained on River Road, Nairobi since they knew they will be using it in the States and as such, no way for USCIS to go back to ground level to research authenticity. Why would USCIS waste their time on such a tiny document?

Kenya is becoming a joke because of these stories/ things.

Yeah that's what I thought. Basically wife is eligible for AoS but they thought that since she is US citizens wife she has rights just based on that. We seen this on VJ forum - US citizens thinking that just being married to foreigner gives them some kind of right to be untouchable in the US.  Claiming that USCIS was racist was probably to just cover the fact that the couple knew something was wrong from the start but they didnt want to admit that.

Suing USCIS definitely was a bad choice and everyone on this forum who considered that, should read this.

Believe me, I know one personally. Sheesh..

Sounds like she had a temporary status, possibly as a refugee, which allowed her to legally be in the US.

USCIS seems to not believe she is legally married. But there is always more to the story. I found the lawsuit he filed but I don't have a PACER subscription.

My PACER is definitely active as I use it every day.  I can definitely pull the suit.

I don't think any reporter has actually done any work on this yet.  All I can find are stories showing a brief intro about this couple and then they print the husband's letter to Trump.

Definitely reads like a letter to the editor rather than a piece of journalism.

Really? Interesting. Wonder what circumstances drove her to this. Maybe this is where someone was caught.

Refugees come to Kenya from neighboring countries. Not the other way around.

So many holes who knows what the truth is, maybe a dodgy asylum claim initially?

That's what I said in my last post. People from this region in Kenya are known to do things like this..embarrassing. It's a norm to them back there. And they brag about it openly. They end up carrying the same character abroad. Look at how elections are run in Kenya. Who wins and who holds the big posts..don't even look far.. look at the shenanigans of the last election. Current president, from same Kenyan region as this lady and journalist, ran against himself but still rigged elections. It was there for all to see. Just Google. But they were busy celebrating "victory.". Embarrassing.

Just pointing facts. I am not trying to make this political.

All I could find was the complaint.  It’s 7 pages of blah blah blah.  Nothing really stated in there except that they married and then filed the i130 and i485 and it’s been in process for too long.  Not a word about their interaction with USCIS or the pretty outrageous claims in the article.

It does look like there’s a motion to dismiss, but I didn’t see any final action.

Zip file with complaint attached.
