I-134 Beneficiary’s Children

Timeline

In part 2, question 12- should I, the beneficiary, list my child, even if he is not a part of the petition, he not accompanying me and he lives with his mom?

I am paying child support, but I haven’t seen any question which asks about it.

Yes.  All children must be listed.

all children must be included on the petition.

 

for the 1 134 and  864, only children living in the home (or immigrating with beneficiary) AND any children or other dependents the petitioner has, even if they do not have custody/live with them

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/19/21 Received Text NOA1

based on the statements above. even if my fiance child is not coming on the k1 visa you still have to add them to your i134?

also as the sponsor do  have to put my children who are over the age of 18

No this is the opposite of the OP.  The child that is not immigrating or is not a child of the petitioner is not part of the household count.  

As the petitioner you put a child that lives with you over age 18 until age 21, or doesn't live with you and has not yet reached the age of majority.

Exactly. As the beneficiary, I listed my children who are not immigrating with me on the I-134. At the interview, they were not included in the household count for poverty lines calculations.

If they would have been included in the household, I would have been required to have a co-sponsor. The children of the petitioner are included in the household.

To clarify, we must list the children in the

I-134 even if they ARE NOT immigrating with SO?

 

when I asked my consulate office if they need to be included they said they don’t have to be if they are not immigrating at this time... 

So I didn’t list them 

now I’m in AP but they never mention this was the reason

I-134 you list the children.  It doesn't specify to only list children that are immigrating or not, but you'd have to provide an I-134 for each person receiving a visa.  The Petitioner's children are listed under "dependents" and I believe you also list the beneficiary/fiance here as well. 

 

Good lord the I-134 is a dumb form. It's not legally binding and doesn't ask for a household count... Why US government why?
