Panicking: Evidence of Lease Doesn't Match Address in USCIS

Hi everyone,

 

It's been a while since I posted on here but I am trying not to panic. 

 

I put my parents house down for our permanent address at the beginning of this process and never changed it. Is seemed to make the most sense since they own the house and we moved around every 8 months therefore it seemed  to make the most sense as a permanent address. Now, we have our interview and  I'm  realizing they want to  see our lease. Our lease does not match our address and USCIS system (my  parent's home); I never changed it because I considered all of the places we lived together "temporary" and my parent's home "permanent". About a  month ago we signed a 12 month lease which I figured is more permanent.

 

I went to change it on the USCIS website and it said if we didn't change within 10 days, it could mean IMPRISONMENT FOR UP TO 30 DAYS AND DEPORTATION! We signed the lease 30+ days ago! I'm in full on panic mode now.  I never meant to be dishonest, I was (and still am) genuinely confused about which address immigration wants to use: temporary or permanent.

 

We  have our interview in 3 weeks. Do I change my address now even though it states possible imprisonment?!?! Do I leave my parent's address as my permanent address, bring our lease with the contradicting address and explain the  situation?

 

Any and all help would be appreciated!! :)

4/13/2018: Visa Status: "Issued"

4/16/2018: POE

6/15/2018: Wedding

 

7/9/2018: Sent in AP, EAD and AOS

7/16/2018: Fingerprint Recieved

7/17/2018: NOA1

8/1/2018: RFE

9/4/2018: USCIS Recieved RFE

9/13/2018: Case Is Ready To Be Scheduled For An Interview

11/15/2018: New Card Is Being Produced (EAD)

Timeline

I have never heard of anyone being deported for failure to update their address.  I would just update it immediately, and relax.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

It's never too late to be honest in these immigration processes. Better to explain the truth than to stumble around in the interview with half-truths about permanent vs temporary residences. Just explain that you weren't aware of the requirement and that you'll be abiding by the requirement from now on.

I have my aos interview in three weeks as well and have a similar question regarding addresses to provide. The address i provided to usicis was my parents address  because my father is cosponsor and i am still a student. Originally we were planning to reside with my father until I graduate and able to provide on my own but a few months ago my grandmother suffered a stroke and we decided to stay with her and help my grandmother around the house. I have not updated uscis with the address because my parents house and grandparents house is only 4 mins away. 

will we have a problem and what should we do ?

I spoke with a  lawyer  about  my situation and he said although the wording sounds dire, it is usually non-issue if you still keep track of mail at the address provided to USCIS.  The rule is intended to prevent people who are trying not to be contacted/running from  the law. If you still track the mail at your parent's  address then that is what they want to see plus he is a co-sponsor so obviously you keep track of the mail well.  He said you could  update your address at the interview, although  I update ours online yesterday. 

 

It becomes more of a possible issue if you moved from apartment to apartment and forgot to change the address and the first apartment now belongs to a stranger.
