please help approved then refused pending more information staus still says refused

Timeline

hello in in England I had my interview and was approved on 24th may the chap said go celebrate everything was in order and await my visa.  6 days later I had email saying refused pending more information. They said my partner did not make enough to bring me over to usa and get married. we had a lawyer do all our paper work and assured us they would take in to consideration his ssi along with is work wages wich both combined made over 3.000 more than required.

 I was all set to leave and knowing I would never have to say goodbye to my love one again they have asked for additional income monies from house savings bonds ect which we can not submit as there is no more resources so we was told by our solicitor to get a sponser which I did and have summited new forms w2 ect I checked status today and it has gone from yellow refused to blue refused. with todays date on it. does that realy mean we are officialy refused or is there still hope like the other cases I read about that it is just because they have looked at my case , how will I know when I have been refused 100 per cent , im st destressed I cant get a job and I am almost homeless. please some one help me.

I'm sorry that you are experiencing this.  Unfortunately, this is yet another case which proves that the ONLY indication of an approved visa is when the status changes to "Issued"......regardless of what the Consulate Officer says.....It is also proof that the "public charge" issue is an extremely important factor in the immigration process.  If the CO is convinced that you will not become a public charge based on the joint sponsor financial documents, there is a good chance your visa will be approved....good luck.  I hope it ends well for you and your fiance....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

thank you so much your message gives me some hope. I think people should be aware that this can happen its so unfair to be approved then have to go through this stress .its so alamrnng to see refused of status after it being updated. do you know how I will know for sure if ive been refused.  Thank you once again for your help .

You have been refused, when the status changed to "refused" (I don't know about blue or yellow or whatever). However, refusal due to the "public charge" concern can be overcome by providing a joint sponsor or additional income/assets. There is no other way. 

 

Meeting the income threshold does NOT mean automatically an approval. The CO takes into account the totality of circumstances to make the decision (your age, your part's age, medical history, your geographical location in the US....). We have seen increasingly that barely meeting the minimum income amount without anything else can likely result in denial.

Also, the CO (the person who interviewed you) most likely is not the sole decision maker. He has to submit the case for his supervisor and the immigrant visa section chief to approve, and if they have concerns, they can override the interviewing CO and ask for more evidence.

thank you for your reply , they requested evidence of  savings bonds house value as we didnt have any of those so we sent in sponser affidavit with a cover letter asking them consider it for approval. hoping they accept it.

Blue Slip: A 221g Blue slip is given when the additional documentation is required. After submitting the required documents, a decision will be taken by the Consulate. Pink Slip: A 221g Pink slip is handed out when your application needs further administrative processing.J

The same thing happened to me.....was told that my paperwork was good and case was approved but I got my passport back and was informed to get a joint sponsor. Right after I got one and sent the paperwork to the embassy, it took just over 1 week before I saw the status changed to Approved.

Hang in there, no need to be scared.....get a joint sponsor (if you can) and resend your joint sponsor paperwork.

London allows you to self sponsor a K1, the simplest solution.

They did consider it.

There is a minimum requirement for consideration. There is no minimum level to ensure approval. The CO looks at the totality of the circumstances.

Odd thing is that London do not seem that bothered about a I 134, they seem to realise it is meaningless.

As working is limited when receiving SSI, they are not considering your income from your W-2s as consistent income. They are asking for additional evidence for overcoming public charge.

thank you so much for your resonse and a very big congratulations. I can only imagine how excited you was to see you had been approved. I sumitted a joint sponser last Wednesday when I lookoed today it said updated 10.30 so I expect they have received it. but still said refused although I have been told it will stay refused until approved or issued, they still have my passport . once again thank you

How will the two of you manage in the US in that case?  It isn't cheap to live here, and there are far fewer social welfare programs than in the UK.  Health care, for example.  Have you thought about how you will afford that if your fiancé is subsisting so close to the poverty line and you cannot work?
