Refilling I-751

My husband's I-751 application packet was returned stated reason for the return is that it was filed too early.  The letter also stated to refile/resend application.

 

 All the documents were stamped including the original money order we sent.  I know to refile; however,  I'm confused on if we should send new documents including a new money order and the other supporting documents or send everything back as is. What should we do? Please advise and thank you.

You can just send everything back as is. Depending on how much time you have until the 90 day window, you could also go ahead and add any supporting documents that you may have missed at the time.

you can send same money order and evidence, but your I-751 will need to be signed with the new date.

Make sure to send your documents with the correct and updated signature and date. Early filing results in an automatic denial but this does not mean all is lost....just send everything back within your filing window of 90 days.

I'm getting different things to do.  I called the USCIS office and they told me to send everything back even with the barcode on it. However, the rejection letter stated to complete the  application fully and send it with the supporting evidence within our 90 days.  We passed our 90 days because they sent the application back and we received it June 6th. So I'm really nervous about everything and still confused as to if I should sign a different application with the most recent date or use the old one that was rejected and barcodes??

You do not have your Timeline filled so we cannot get proper details about your case.

 

Nonetheless, what date did your 2yr green card expire?

August 24, 2019 is that expiration date on his green card.  The USCIS received  the I-751 application  on May 20, 2019 and it was rejected and returned stating  it was too early.

It indeed was. 90 days before Aug 24, 2019 was May 26, 2019.

It sucks that they sent it back after receiving it probably 3 days too early BUT you are still within the 90-day filing window. Go ahead and follow the instructions they gave you on the sheet. Make sure to sign the date as the date you will mail back out the packet and put the current date on your check as well.
