We're VAWA petitioners, we're granted access to public benefits from the moment you receive your Prima Facie, they cannot deny you based on using means tested benefits, please please please understand that VAWA self-petitioners have different requirement and benefits than normal petitioners.

There is a reason I filed for the fee waiver, you think if I had the money to pay the fee I wouldn't?  Let's ignore the fact that I'm in classes most of the day, even if I wanted to work part time in the evenings I would have to pay childcare for 2 toddlers and an adult daycare for my disabled family member out of pocket, the minimun wage in the state I live in is $7.25 even if I got paid more than that all of my earnings would be going to pay for child/adult care.  So please don't think that I'm trying to be lazy and asking for a fee waiver because I don't want to work, there is alot more going on in my circumstances and reasons to why I'm receiving benefits.  The entire point of my post is that I qualify for the fee waiver based on their own criteria and they are denying it and ignoring all the evidence I've sent them showing it.   I shouldn't have to justify why i'm going through financial hardship on top of everything, that's similar to victim blaming. (and I mean this in the sense that they ask for proof of hardship, I should not have to explain why i'm facing that hardship or have them judge and deny it because they believe I can work solely on the fact that I received my EAD.  I couldn't even get a SSN without the EAD, so it was needed for more than just work authorization.)

Oh, and let's not forget that my EAD expires next week, because I've been trying to get my AOS and my EAD renewal accepted for the last 7 months but it keeps being sent back. so now I really can't "work and save up money" to pay the fee anyway.  🙄

sometimes it’s better to just pay the money its for ur own good!!you can burrow from someone.Trust me USCIS don’t care because the rate at which people abuse the system with fee waiver is alarming. So i will advice you to look for money and pay so that they won’t deny ur application.

I am beyond frustrated!  So it's been over a year since my Vawa was approved, twice now I have submitted my adjustment of status package along with the I-912 Fee waiver and twice it has been sent back denied, we are at a loss because the second time we included even more information.  I'm a full time student, we receive section 8 housing, Snap food benefits, both my toddlers have medicaid and our only source of income is $850 in social security disability, I included so much information and bank statements, my school paperwork showing I receive the full pell grant, proving all the means-tested benefits I have and they still denied the fee-waiver even though we are definitely below the 150% poverty line and proved we receive several public benefits.  What the heck  else am I suppose to provide for them? The attorney who helped me submit everything is furious, saying that it absolutely qualifies and that she doesn't understand why they are denying fee waivers that more than qualify under their guidelines.  I'm contacting my Senator's office in the mean time as well to see if they can help me.

Oh, and my EAD expires next week, so if they were denying it based on that fact alone that I had an EAD, well NOT ANYMORE. :(

I will be frustrated too. Here are some information from USCIS website reason they denied the waiver.... Make sure you and your childrens signed each I-912 fee waiver form also for each AOS form you need to submit I-912 waiver... There is an email when they denied you or your attorney helping you may email them to see what is the reason.

Common reasons why we deny fee waiver requests https://www.uscis.gov/feewaiver#common

The form for which you are making the request is not eligible for a fee waiver.

You did not sign your Form I-912 or the written request.

All applicants (those 14 years of age or older) filing the request did not sign Form I-912 or the written request (or, if under 14 years of age, did not have a parent or legal guardian sign for them).

You did not provide evidence that:

You are currently receiving a means-tested benefit;

Your household income is at or below 150 percent of the Federal Poverty Guidelines; or

You are currently experiencing a financial hardship.

You submitted evidence in support of your fee waiver request that is not in English, and you did not provide a certified English translation.

If USCIS denied your fee waiver and you are not sure why, please read the denial notice (Form I-797, Notice of Action). If, after checking the denial notice, you still do not understand why we denied your fee waiver request, you may email us at lockboxsupport@uscis.dhs.gov.

Regarding EAD C31 You can submit the renewal with I-912 waiver please do it now so you can get the 180 days extension and at least you can I have your EAD until your Fee waiver for AOS is resolve.

Thank you very much!

So they will direct it by themself. Right?

They will transfer to Vermont internally but it will take a longer time. This happens to me, I have to ask the help of my congress person to inquired and help me because my 180 days extension was expiring as well. But the transfer will happen, don't worry.

Hello again. My husband pushed me and slapped me on my arm and grabbed my laptop from me and I asked me when I am going to pack and leave. I said why are you hitting me then he turned around and started to record crazy things on his phone saying I’m pushing him and abusing him. Omg, I couldn’t believe he did that. I called the cops and told them  what he did to me but they said there is no physical evidence and they cannot do anything. They left just like that. And I’m left feeling like a lost child. Help please.

Next time when he does that call the police, he might hurt you because his heart is blinded.

When you're dealing with dangerous people..there's no guarantee of a "NEXT TIME" she mentioned the cops came around but couldn't pin anything on her abusive spouse! Many folks have been killed and the killer walks just like that..they can claim it was done in self defence with the help of a seasoned criminal attorney! If she values her life and is not in anyway handcuffed or tied down in the apartment..the best thing is to run to safety..she's not a tree planted in a spot..she can move! A word is always enough for the wise as the saying goes!

I'll take two lines from your statement as it's contrast drives home the point I've been trying to make! ......

"and you are his wife you have the same rights to be in your home, Marriage also give the other significant rights".......

"Prepare yourself your safety and life is more important than anything else."..........

My point is we give up all rights when safety is our immediate need!!! Run girl run!

Wow. I thought I read so attentive.

Even if my I-485 is still pending and I’m not sure if they transfer it to Vermont.

Can you advice me please what can I do now?

Probably Chicago will transfer to VSC,but it might take months.Write to Chicago field office and ask them to forward to Vermont, send a copy of your I-485 and I-360 receipt as well.

Hello guys. I have a similar situation to that of lonelybuthopeful. I came to the US 5 years ago and met my husband in Aug 2018. We got married in Mar 2019 and I moved to Arizona with him. He was the kindest and most caring guy you could ask for. He filed the I130 and I485, I864  and i765 in April 2019.

In June 2019, things began to go south. I found out that he was cheating on me by flying girls from out of state to Arizona and leaving for weeks. I told him I feel like he is having an affair and he told me to leave his apartment and leave his keys on the counter because he doesn’t want someone who doesn’t trust him.  He’ll leave for a week and leave only $50 to get groceries. I’ve lost so much weight since June, over 10lbs. He started creating unnecessary arguments. He’s been saying this is not going to work and calling for an annulment or divorce and threatens to withdraw the paperwork. I’ve been so stressed, emotionally, financially, and mentally. He even forces me to have sex with him.

He just told me I have to leave tomorrow and I should start packing my things because this is not my home as my name is not on anything. He said if I don’t leave tomorrow he’ll do things the “harder” way. I’m fearful. I think he may call the cops or even ICE on me or even hurt me. I don’t have anywhere to go. What to do? Please help.

Find a shelter for victims of domestic  violence and leave the house, but forget about the infidelity, infidelity is NOT grounds for VAWA or even taken into consideration.

Hello ladies ,

I've received an update on my case by email stating this :  "" Correspondence Was Received And USCIS Is Reviewing It". What does it mean ? I'm a little bit stressed and I just received my ead and starting working already. I have my 2nd prima facie extension till December which was sent to me before the expiration of the first one. My priority date is April 2018.

Am sorry to hear that, but please try this summer work your self up save up and send the application,  its for your good, the fact that you have a lot if public benefits might be the reason for denial, maybe the officer recieving your application is looking at that and denying you. Am sure he is like. If we are paying for her before he/she gets their status what if they get it? They won't work!! So please get the funds and just pay and get your case moving! Am sorry if I offended you, but in this political climate be careful

VAWA petitioner does not incur in public charge.

Hi..did they send you any RFE? Or did you just send any documents to them...that could be a reason..but if not..they are probably working on your case..sometimes they too get feedbacks on general investigations concerning issues like security checks..etc..also it's not uncommon for folks to get all sorts of updates that seems weird from USCIS..fret not; all is well!
