Ziongirl i think you start counting from once your local office received your file.

January 2019 to June 2019 it has been only 5 months i guess

good evening VJ family, i have one question and please if anyone knows something or is going tru the same please share. 

 

My question is i just submitted my request for evidence but my biggest concern is that in 2018 i got a criminal citation it was for a metro fair i mean when i used the metro my car didn't register for some reason and i got stoped and got a ticket a citation for a metro fair. When i was stoped i said i have money i can pay the fair and i apologies that for some reason my card didn't register but they didn't let me so when i went to court i paid the penalty  it was 25$and nothing happen even the judge laughs and looked at the officer like really why didn't you let him pay and now you are waisting my time  waisting. And that was in 2018 the beginning of 2019 like 4 months before receiving my first RFE, the weird thing is that even after my lawyer requested the additional FBI background investigation it came back and it said that i have no criminal background no convictions and no arrests, in other words the citation didn't show on the FBI background check???

 

But when we submitted my RFE i wrote a affidavit explaining the incident with the metro card and included the FBI background check that say i have never been arrested or committed any crime, and my police clearance  from hoe that says  the same no arrests no crime and no prison. 

 

And now i'm so scared that my VAWA petition will be denied because of that metro fair citation, please if someone can tell me is that a possibility or a reason for denial i have nothing else no crime no arrests but i'm so scared  now.

 

Once again i apologies for this post but i hope that someone can give me an advice because if i get deported, because of that citation i have nowhere else to go.

Well you'll have to trust the FBI verdict/findings and your home country clearance attestation! If FBI says you good then I guess you good! Rest easy...oh but I know how you feel..take the FBI's word then!

There’s two side to what your saying. 

1. If you tick no on your I-485 which ask if you were ever arrested or not it shouldn’t be a problem when your getting adjustment of status interview since the FBI background check said no. 

 

2. If you had tick yes to the above you need to provide court documents regarding same saying it was paid, thrown out or what so ever. 

Also when I did my interview they corrected anything on the I-485 so if you had made a mistake you can correct it there as well. They are gonna tell you before starting the interview so if I was you I would get 2 copies from the courts office about the outcome of your case and keep it Incase because it all depends whether you had tick yes or no on the i-485 form. Hope it gives you an idea.

Base on this new information it wouldn’t matter because the incident happened after you filed VAWA and since the FBI came back clean you have nothing to worry about.

Remember I told you that you ain't got nothing to worry about? I read your post..you're good! Sandra will still have something valuable to say..do not entertain unnecessary fears! It jails you within yourself! Set yourself free..it's gonna be okay!

Card production..was March 28th..card mailed 1st of April...got it on the 4th.. Waited for approval update..which came on the 26th of April..then the actual letter came few days later..about 4 or 5days later after the update online that they will send my approval notice besides the online update. Does this help?
