Hello. I filed for VAWA in November 2018. I just got divorced June 2019. I received my Prima Facie in December. What do I do now? I will need assistance as I need to move out of the house with my daughter and my alimony will end. I'll get a small lump sum alimony payment which I'll have to use a portion of to pay my legal fees. I'll end up with a very small amount. 

 

I'm moving in with a friend but I need support cause child support has been reduced due to me ex having more time with my daughter. I can't work as I filed C-31 and will not have working papers for some time.

 

Do I need to report my name change as well and if so, to where?

 

I live in NJ.

Daughter will be with him only  96 days in the year but I'm not too concerned about that just what will I will qualify for now? Yes the alimony is income but that lump sum will go mostly in legal fees and move out expenses once I receive it.

US citizen 

If your spouse is US Citizen then you can file C9 for I-485, I-765.  However, @sandraj always warns us that if VAWA not approved you will be put in deportation when I-485 is denied.  

 

Regardless of what you spend the alimony on, Social Services considers alimony as income and it will be counted against your benefit application.  It does not matter if you have Prima Facie, you still have to qualify for the benefits.  Prima Facie only waives the five year requirement for specific benefits.

Timeline

The drama with soon to be my ex wife continues. She called me this morning asking me to sign the divorce papers online and scan and send it to her immediately. I told her i already signed the divorce papers and i sent them out to her Po box and to the court and it was going to get to the court on Saturday 

I called the district clerk and i was told i had till the 24 of this month to send it to them and since it was getting to them tomorrow via mail they would open it on Monday or Tuesday and i was given a number to call on Monday. 

 

My wife has been calling my phone non stop and sending threat messages calling me a spammer, being childish and i was not going to get anywhere without her and she was filing a restraining order on me. So,i in turn called the district attorney in Houston and made an appointment with them on Monday to file a restraining order against my wife.  Does anybody here know the requirements and prove i have to show to get one ?

These crazy spouse just do not stop! Isn't that the lady that said she loves you the last time?😏 run! 🏃 Damn! She crazy for real! Anyway you have most of the proofs you need! Text messages and calls....transcripts...ordinarily if you feel threatened in any way they should listen to you...I hope you get over this real fast and put in all behind you...

Yes going in person will help you understand.  Depending on your state they count child support as income also.  When they do the income means test, if both your alimony and child support exceed income guidelines, you do not qualify for benefits.

Yes this was same lady who told me she loves and misses me. I’d wanted this divorce peacefully that’s why I did not object or fight it when she filed for one. I changed my mind on a restraining order but am going to get one on Monday. I am tired of her non stop calls and threatening messages saying i used her name for accounts but all I did was open joint account which we did two years ago and she walked in the bank with me, we opened a life insurance which she accepted the terms and conditions on the phone so how did I use her informations. I am tired and all these is affecting my coordinations at my job

Try and be easy with yourself while doing the necessary! I hope both y'all signatures are on documents pertaining to you both? That way she can't claim otherwise! Now you see why most folks here adviced to take action which you have been stalling? You don't take your chances with unstable people, you take ACTION! I really hope you'll follow through this time!

received curtesy letter can’t remember the month but it was 2018.

i got no updates online about interview the letter just came in the mail two weeks before interview. I’m in Atlanta
