Hi Guys,

My EAD was approved  and card was sent on July 17,2019. I never received this card because it was sent to my previous address and USPS did not redirect it to my current address ( very inefficient bunch - I previously filled a mail redirection request form more than three months prior and it was verified, because I know how slow USCIS is when it comes to updating address) . My mail was neither delivered to my previous address nor my current address and was lost in the system for a several days. I recently received word from USPS that the card was returned to Sender. I called USCIS but they would not give me any information because (according to them ) "my case is sensitive"  since it involves a VAWA petition. I am confused right now because I planned to travel next month with my approved EAD/AP. I already completed a " request for a replacement card"  on the USCIS website.

Please advise

Thank you .

Hi, I'm so sorry to hear this :( I got the same issue but it was an RFE that couldn't be delivered to me on a timely manner. I thought USPS re-directs all mail but not goverment mail, while some mailmen do some don't. I had notified USCIS multiple times with a notarized letter but they wouldn't change my address. I would recommend reaching out to USCIS in Vermont via mail and let them know you changed address with a notarized letter, and also you can ask your congressman to inquire on your behalf about the change of address and sending the EAD to correct address.

I also got in touch with the person that moved in the apartment I used to live in and asked her to hold anything she saw coming from USCIS to me and she accepted, if this is possible in your case, it wouldn't hurt.

Do you have a pending VAWA? if you have a pending vawa and receive  a notice to appear in Court you have to go to the Court to attend the master hearing and then ask for an individual hearing , the Judge will not remove you until your VAWA is adjudicated.

I have not submitted my VAWA application yet. Still a work in progress with gathering the evidence. I think my lawyer wrote a letter to US CIS to transfer the case to VAWA but my husband apparently withdraw before they got the letter. @sandranj what do I do? Will I still be able to file VAWA?

You ain't gotta go no where! Except of course you want to...you can always file a new i485 yourself based on your i360 in view! Let the monster go..you don't need that negativity! Better days ahead!

@Stillwinning!!!😊 I have not filed my VAWA yet. Still gathering the evidence. Can I still go ahead with filing VAWA? Thanks for your reply.

You can definitely file vawa as long as you have all the evidence to support your claims! Since this i485 is denied, you will file another alongside your i360..but for now the situation must be addressed! Considering what sandra adviced earlier..follow due procedures..if you had a pending VAWA it would be better..it's probably time to send in your petition so you have something to hold on to!

Yes you can file vawa,  there is no problem. How did your attorney submit a letter to USCIS IF you didn't file the VAWA yet?

Hello guys. So my cruel husband withdrew the i130 petition. All my other applications filed with it have been denied...i765 and i485. Saw the update online not too long ago. Will I have to leave the country? Anyone know if I’ll be put into deportation? I’m so nervous and scared right now. I haven’t gotten the notice of denial letter yet but it’s on its way.

Hi there! We had similar case but my ex did not withdrew the petition, he was not at the interview but all of my petitions were denied. I’ve got a denial letter too and my EAD under C09 at that time lose it’s validity. I felt the same way too. Don’t be scared, while you wait for the denial letter gather all the necessary document and communicate with your lawyer. Be proactive on this. Good luck!

I just spoke to them and was told that it was actually a change of address they had done for me to their office. Now they just said they will ask to have the case change to VAWA.

Hi there. I’m nervous but curious at the same time to know what the denial letter will say besides from the fact that my application has been denied.

I can understand your anxiety but you're only tormenting yourself over something that doesn't quite change anything! Go easy on yourself..I believe someone here already told you they at one point received a denial letter, but today they are awaiting their VAWA approval here in the USA! It don't matter what the letter says..you'll still file your vawa and by God's grace you'll be approved! All of these uncertainties will be behind you!

Hey Everyone!

I am just adding my timeline for reference. I had done concurrently filing of I130, I131,I765 and I485 in March of 2018.

On July 13, 2018 I filed I360 VSC

Got Prima Facie on August 6, 2018 and also requested that they keep my I765, I131 and I485 open which they did.

I received my EAD based on I765 in June 1, 2019 after a long and stressful wait.

My prima Facie expires this August and I’m wondering should I wait to see if they will automatically send a renewal as they stated in the prima Facie or should I just go ahead and send a letter requesting a renewal just in case they don’t send it.

I haven’t gotten any RFE as yet, I pray to god I won’t get one. So for now I’m just waiting on what I hope will be good news.

Awesome! We hope you don't get any RFE as well..matter of fact, everyone hopes they don't get it! As for the prima facie document, do you benefit from it? If yes then go ahead and request it as they may or may not send..wish you all the best!😊👍

Hello Folks, I have a weird question. My i485 case status changed to this details since April 2018. I called the number that the website gives to me, then the customer service said my case cannot found at this time. And I checked new website(my.uscis.gov), it showed “case was received”. I’m confused about it. It is so weird . Does anyone have the same experience? Please advise. My vawa approved on July 2019. Thank you very much!

I will know my faith on my interview next week if they will hold the case or send a denial notice. @sandranj if they send a denial and we continue to work under cancelled c09 ead and the employer doesn’t know about it, will it affect the vawa case or subsequent i485 adjustment? Thank you!
