Folks,

 

i have a couple of questions. Kindly advise.

 

- For vawa based AOS, can i choose an attorney from a different state/city than mine? If i do, would the interview be held in attorneys city or my city? Please let me know if there are any other implications as well.

 

- If i am not able to file AOS for my kid at the time i do mine, what options would i have? Say they join me in US 2 months after i file my AOS, can i at that time add them as beneficiaries to existing AOS application? Or will i have to wait until my GC is issued to file for them?

Heard severally that you can, and since the address USCIS has on file is that of the chosen attorney, that's the field office you'll be directed to! If this is confirmed to be the case, the only implication will be you having to fly down on short notice if need be to attend to important matters or interview!

Heyhey, I can only speak on the first question but yes, of course. Immigration is federal law. so your and your attorneys state don't matter.

My sister outside the United States is writing an affidavit to support my marriage to my ex wife. Can she also state or talk about the abuse in her affidavit ?

If you were talking to her about the abuse and sending pictures, she could state that and your character change due to the abuse.

Yes, you can choose an attorney from a different State. The interview will be where your attorney's office is located.

 

If your son is in the U.S in his AOS he should file form I-485 anytime, if he is abroad you have to file form I-824. He doesn't need to wait for your AOS approval can file anytime, but if his interview will be scheduled after you get your green card.

She can mention about the abuse, what she knows and when she found about the abuse. She should put her full name, date and place of birth, address,phone number and she should write " l declare under penalty of perjury (under the laws of the United States of America) that the foregoing is true and correct.".

It means your I-360 was approved and you will receive the work permit category C31.

 

Your form I-765 probably was denied because you made a mistake in your I-765 or did not submit all documents necessary to obtain the work permit.

File one form -912, part 3 (form being filed) put I-765 and I-131.
