I was still married to my abuser at the time of my interview and I’m currently still married. I have my Green Card. Planning to get divorced thou so no worries.

Yes if you don't file concurrently with I-765 you need to file I-131 separately and  paid the fee, but if you cannot paid the fee also file I-912 for a fee waiver.

Sorry for late response..I've told you previously that you can..the waiver will enable you do it without payment!

For neither of them you are requested to be divorce BUT according to my lawyer for I485 is best “just in case” you are in the process or best if you are already divorce.

it is NOT required by law!

it will just suit better to the immigration officer (I am guessing) all depends who do you get in the interview.

Hey Guys, want to give my experience on this topic when I went to my initial AOS interview here in NYC office, After my lawyer handle I-360 receipt to the officer and explain to him the marriage was broken, the officer ask me for my divorce decree my lawyer promptly responded we haven't filed yet, His face change and he look at the I-360 receipt which  is June 2018 and my Interview was on May 2019, he said OK well your I-485 cannot be process now since I-360 is pending in Vermont unit i will ship I-485 to Vermont and you will be scheduled for a second interview you will have more time to start the process.....  I did not mind what he said I was just happy he held my I-485. Until i see this conversation on here, Every officer is different but USICS expect you to divorce your abuser at some point if I-360 taking 16-24 months plus the adjustment of status time we talking about almost 2 years or more process, we have a consider time to get divorce or to at least try to start the process. Is logical to do so, because been married to someone is also being tie and have  jointly responsibility in the eyes of the law. So Maybe NOT require at the interview but is expected.

(just my personal and point of view as I saw the officer reaction your experience can be different)...

Appreciate you sharing the experience. Every bit of first hand information helps.Looks like it all comes down to officers personal reactions. Although its great to know from rest of the folks here that divorce is not required by law. Happy weekend👍 😊

I got an update on my renewal for ead to card is being produced.. my ead was going to expire in may2019 my lawyer sent the renewal April 2019

Timeline

Nov 2016 field vawa i360..i765 and 1485

Dec 2016 biometrics 

May 2018 vawa approved 

May2018 received ead c31 

October 2018 i485 sent to other location

October 2018 courtesy letter rfe medical exam

Dec 2018 responded and sent medical exam 

April 2019 sent ead renewal 

Jul 2019 card is being produced 

 

Still no interview date 😕 at least i got another year of ead approved

May 2018 approved case..no interview?  Where are you located? This is a little unusual! Someone here approved in April 2019 already has interview set for this month! You need to make some moves..contact congressman asap!
