I have another question @sandranj I already have i1485 filed concurrently with i360. I told my attorney at the time to file for AP as well. I want to see my family so bad. She said not to leave the country until VAWA is approved. Can I file i131 on my own and use a safe address? Do all the forms you submit have a unique return address? My forms were submitted using my attorney's address. I want to submit i131 on my own and use a different address. I wonder if it will change the address for the other forms as well. I was never on removal proceeding (or not yet) and have no criminal record. If I already have Prima Facie, and my AP was issued, is it still likely to get Notice to Deny while I'm abroad? I know I'm overthinking.

Sorry just want to vent. It’s just so frustrating that some of us here have to deal with the incompetence of our lawyers. 

 

I emailed her asking about the list of affidavits we sent, just to refresh my mind and to make sure we sent everything. She replied that we only sent 4 plus she sent one from a person i dont even know ( she must have mixed it my case with a different person) . I gave her 8 affidavits, i dont understand why they only sent 4. I know we haven’t even send my good moral certificate and my psychological evaluation yet because she said we have to wait for an RFE to do that. 

 

Is it possible to mail USCIS and ask for the list of all the documents that were sent for my case? And can we send the rest of the affidavits and documents i have? I dont really trust my lawyer anymore. Any advice would really be helpful. Thank you! SEPT 2018 filer here.

 

 

Since July 2018  USCIS is not obligated to issue a  RFE, it's up to the immigration officer, they can deny a case if the person fails to submit necessary documents or to submit proof of the abuse and bonafide marriage. Your attorney needs to learn about VAWA.

 

You can't ask USCIS to tell you what documents they received from your attorney.

You can file VAWA while married and you caan also file while divorced. But if you are divorced, you should file within 2 years of divorce. If you divorce and you are not able to file VAWA within 2 years, the status of limitation will elapse and you will no longer be eligible. So, you dont have to delay your divorce. Let it run its course. What you should rather concentrate on doing is gather everything that will help you proof your vawa case and file as soon as you have everything ready

Hello everyone,  

I have been separated with my wife since June 2018, I filed i360 August 2018 , my wife filed for divorce in July 2018 in Florida , and we had a hearing for divorce July 2019 where the judge dismissed her petition because it was fraudulent and at the time of filing didn't meet the residency requirements,  

However one week before before the divorce hearing,  I received death threats from her and her boyfriend trying to scare me if I ever show up in court and try to defend myself,  which led me to file an emergency order of protection against her and stalking protection against him , in Illinois. 

In the meantime,  she filed one against me the very next day in Florida.  

My question is can she use that against me ? Because I am certain that she will send it to USCIS to try to screw me up somehow.

Vawa Unit will not consider or take in to count any evidence sent by your abuser. No need to worried about that. ... You file on I-360 2016??? No RFE no movement from USCIS yet????? is almost 

3 years I think you should contact your congress office to inquired. Or Raise a service request.

Yes you MUST provide police clearance from ALL places you lived in the past 3 years.

Hey everyone my interview is scheduled for August just a  letter no change on line no updates ..My lawyer called  . 

April 2017 Applicant 

Approved December 16 2018 

August 2019 Interview date 

 

I need new medical so i will let you know the date i get when i go my Lawyer ...

True! It was part of my package.

Even now that I have my interview coming, my lawyer ask to bring them with too “just in case” including my divorce decree from my ex-abuser and obviously my previous divorce decree too.
