Clearly your attorney has no clue about Vawa. He should file I-360 along with I-485. There is a fee to file AOS if you can't afford to pay the USCIS fee then file form I-192.

USCIS will not accept recorded material, see some place where they transcribe the audio to text. Men can apply for VAWA without any problem. The organization you went they have no clue about VAWA either.

I meant to say form I-912.

I just sent in my C09 renewal last week and it expires next month 😑

I have C31 Ead as a backup which is good through April next year. Does anyone have experience with wait times for C31 EAD renewals? I’m assuming if wait times are that long then I should send in Ead C31 renewal within the next 2 months. Thoughts VJ family?

It  doesn't matter the category, the timeline is the same.

hi,

If my husband is willing to sign my divorce papers without me having to serve him with a process server or with an attorney, would that be viewed bad for my vawa case? i wasn't able to find out where he lives now, so I wasn't sure how and where to serve him with divorce papers. but finally I was able to communicate with him through texts and now he's willing to meet. The fact that my divorce petition is going to be a joint petition and not one served by a third party(process server) can have some bad effect for my vawa case? i was thinking it can be viewed as if we are in good terms and never had problems at all? thanks

It will not have any implication in your VAWA case if he signs with you the divorce. Do not go to see him alone, or meet him in some coffee shop.

Hello. I want to ask you for advice. I am studying the instructions for Vawa on the site. I want to know if I have the right to do so, being outside of America. My husband filed for divorce, there was no divorce so far, and made him leave with threats, I understand that I made a mistake, but I was scared. Now I want to fight and get documents regardless of him. Thank you.

You can file for a self petition (VAWA) abroad if the abuse happened  in the U.S, or if you suffered abuse abroad and your husband  is a member of the U.S military or a U.S Government employee stationed abroad

Dear, thank you... the most important question is whether I should wait for a formal divorce? Or can I indicate that at the moment this question is not clarified? When I send documents.

You don't need to be divorced to file VAWa. You  will need a police clearance from all places you lived in the past 3 years. You must submit to Vermont, the address is specified in the I-360 instructions.

If you live in Russia you will have the interview in Russia. As far i  know the U.S Consulate closed is just the one in ST. Petersburg. You don't have to pay USCIS fees to file form I-360. I had several cases of clients that lived abroad and applied for VAWA.

Was it 3 years for VAWA that you have to wait untill you can apply for naturalization ?

3 years if your spouse is a U.S Citizen and 5 years if he/she is a green card holder.

Thank you vety much. I want to know how much it can cost? I have no money to pay for the services of lawyers. I seek help from smart people. Thanks for the answer. Most importantly, I have to understand if I need to drag the divorce process further? longer so that they give me that I want.

I am trying to follow along with everyones timeline but sometimes I get confused. Are you waiting for the interview? If so please ask in the interview if they can change your name back to your maiden one. They may be able to do it, they may not. At least ask! If they do not change it then you will eventually have to pay (or use fee waiver) to get a card later with your maiden name.

WOW   am glad to see you here. I didn't see you lately answering  questions on the VAWA thread.  Folks Villanelle is the VJ member who knows about VAWA more than anyone, and she knows about immigration in general  as well . She is a VJ menber  for at least 7 years.

Hello VJ family,

My Advance Parole is going to expire in on 5th Oct and i have sent the renewal on 26th June but they didn't cashed my check for the fees.  In the mean while i need to travel to my home country for my medical treatment to my home country,

is it safe to travel at this time as my i360 is also not approved any suggestions ?

If yes then what port of entries should be safe to enter ?

I broke my leg and it needs a surgery which is very difficult for me to do it here as i haven't been to my country since ever. My F1 visa on passport is still valid but the status is not.

Your advance parole needs to be valid for you to travel, that is it. You should not have a problem to reenter if you do not have  an asylum case  pending or are in removal proceedings.

My husband filed for divorce, not me. The divorce process is still ongoing, but not over.
I am outside the country and I have a lawyer. Should I no longer get a divorce? Is there more time for a divorce or is it not important? I don't speak English very well, sorry ...
Should I have time for a divorce? a lot of time ... Does it matter or not?

My evil of a husband is threatening that he will go to my i485 interview marriaged based no matter. He will spew lies and talk about me. I already have prima facie and was going to the interview hoping the io will hold my case pending i 360. I’m afraid his words is going to affect my i360. My fault I didn’t pursue the case and restraining order extension! He played me that he’s changed. Glad I didn’t cancel i360 for this interview!!! I’m scared!

It will not affect your VAWA case  what he will tell to the IO, but i believe he will withdraw the AOS and the USCIS will deny the AOS,  and you should refile another AOS after the denial, but go to the interview as well.

I thought we can re file the I-485 anytime after it’s withdrawn ... not necessarily have to wait till vawa approval ... it can be re filed the next day the petition is denied ...

isn’t that true ?

Once the AOS is denied you can refile another one  right away.
