I broke my leg and it needs a surgery which is very difficult for me to do it here as i haven't been to my country since ever. My F1 visa on passport is still valid but the status is not.

You shouldn't have any issue on reentering USA before the AP expiration date. When reenter only enter base on AP, don't need to mention your F1 visa if the status is not valid make sure they stamp your passport with Parole Stamp.

Hi VAWA Family!  Hope everyone is doing well.

 

Sorry just want to vent. It’s just so frustrating that some of us here have to deal with the incompetence of our lawyers. 

 

I emailed her asking about the list of affidavits we sent, just to refresh my mind and to make sure we sent everything. She replied that we only sent 4 plus she sent one from a person i dont even know ( she must have mixed it my case with a different person) . I gave her 8 affidavits, i dont understand why they only sent 4. I know we haven’t even send my good moral certificate and my psychological evaluation yet because she said we have to wait for an RFE to do that. 

 

Is it possible to mail USCIS and ask for the list of all the documents that were sent for my case? And can we send the rest of the affidavits and documents i have? I dont really trust my lawyer anymore. Any advice would really be helpful. Thank you! SEPT 2018 filer here.

I'm not sure exactly who has the worst attorney yet..but Damn! The things these people do! 👎 really sad! Why would your attorney want to wait to get RFE before sending in evidence? It's like saying I wanna get burnt first before I take my hands out the fire!😳 how about take your hands out now before getting burnt?😏 I'm really not sure USCIS will want to go back n forth giving you a list of all you sent in..usually people make a list or copy before sending out! Like I said I'm not sure..but your attorney obviously doesn't care..they just want to bag the dollars and it's on to the next!😕 they are never committed! That's why I kept giving my attorney mad heat that when I got aporoved she was sooo relieved and told me now she can breathe! It's beyond sad the way they carry on...if you can please persuade them to send in all 8 of your affidavits, plus other evidences you have at hand as we are able to send in evidence anytime before the case is decided!

Hi, I finally received the RFE. Asks for qualifying relationship plus good moral character. My wife was born abroad and I do not have a copy of her passport. Anyone with an idea of how I can get a copy of her Consular Report of Birth Abroad (CRBA)? Any guidance will be highly appreciated.

USCIS described qualifying relationship to me in my RFE as proof of marriage! It's different from bonafide marriage! Your marriage certificate should suffice..it shows you had a qualifying relationship with your spouse! As one of the criteria for VAWA petition is to be married to a USC or LPR! So tell me did you initially submit your marriage certificate?

Yes, I submitted my marriage certificate. USCIS has clearly asked for any of the following: Passport/Birth cert/CRBA/Naturalization document, etc. She and I have little to no communication, so I need to be able to secure a copy of any of the documents without annoying her.

What if your lawyer tells you that you only submit what the USCIS ask from you and nothing more as evidence affidavits or proof of good moral character. in a few words they don't like to be overwhelm with documents this is what i was told b my lawyer ( , and according from what i'm seeing here that not entirely true, so yes you are right be careful when choosing a lawyer.

This one is a little tricky..I hope @sandranj or anyone else who has an idea how to obtain the requested document can chip in... You may have to get in contact with her though...not sure but stick around lots of folks would give their suggestions!🙏 if you don't mind where exactly was your spouse born?

Qualifying relationship has nothing to do with her citizenship statues which is what u seem to be asking about. Qualifying relationship means proof of marriage. Thats what you should be trying to proof

That's exactly what I thought as well...but from what's going on I can sense that the spouse in question may not be an LPR or USC..because USCIS is able to access that information without any 3rd party! They probably do not have the data they are seeking...just my thoughts nothing factual here...😏

Exactly! They just want to collect money and after that, they dont care anymore. I still have a remaining balance and im thinking to fire her and not pay anymore if she keeps doing this. I emailed her and called the office and she didn’t even care to respond. I asked to get an appointment to meet her but The receptionist said she’s in court and she can’t give me a schedule yet until she talks to my lawyer. How would i remove her as a representative and just do things by myself? They just make things worst. Also from my EAD renewal few months back, it was already out of processing time but they didnt do anything so i asked help from my senator and representative without any help from them. Im just so jealous of Some people here who are so lucky to find themselves efficient and compassionate lawyers! 😩

Qualifying relationship has everything to do with the spouse being United States Citizen or Legal Permanent Resident. I know. Because I received that RFE before after submitting marriage certificate.

Hmm! I am learning something today about the legal Language used here. My understand was same as stillwinning quoted above as the difference between qualifying relationship and proof of bonafide marriage.
