So,I spoke to a divorce attorney as most people advised I do and showed them the paperwork my wife sent. I also spoke to the law library in the city where my wife filed the divorce from and I was told by the attorney that my divorce was a straight case and was uncontested since we both are on same page, have no kids and properties. I was also told by the library that when I send my wife the signed papers that she’ll send me the decree and which I’ll sign and send back to her and she’ll send back to the judge who signs the final divorce decree.Β

Am am more worried about finishing up with my evaluations, therapy and getting the money together for my immigration lawyer than I am worried about this divorce. My wife just wants to use the divorce to send me out of the country because she knows once she files for the divorce, she knows it affects my i485 since we had our AOS interview January and still awaiting a response for the AOS concerning the AOS interview.Β 

I am so stressed out and eating less these days.Β

After, I picked up the divorce papers on Friday. My soon to be ex.wife sends me a text message Β saying she still loves me and terribly misses me. I just laughedΒ

Great thing you sought aΒ legal view on the matter! The divorce doesn't affect your case in any way as you've been told severally! I'm not a relationship expert but you really shouldn't be with someone who plays with your mind and heart in that manner..talk about I love you..after I've hurt you..nah! Just move on..VAWA is a completely different petition..regardless of what happens with your i485..if your VAWA is approved you can always adjust status based on an approved VAWA! #just my opinion!

Yes you’re right. But, what am worried about is since she filed the divorce first does it affect my vawa. And for those who their spouses divorced before they filed vawa, how did you get your final divorce decree after the divorce was finalized ?Β

Who filed for divorce first is never and has never been a criteria to qualify for the petition! I've seen various responses including mine assuring you it doesn't affect you..since it doesn't affect your VAWA it will help to focus on the way forward..for more assurance these informations are online..read more about VAWA it probably will help give more credence to what we've been saying!Β

I have always wanted to know the answer to this here question but watch this...my card production date was March 28th..official approval update was April 26th..but in an answer to an enquiry I had made through my representative to USCIS, they used this phrase.."your constituents case was approved on the 28th of March....." This here statement answered the very question you asked! When your case is approved, then they produce your card..so I think card production is the same with approval! It's just that after few paper works and all other administrative processes, it is then updated to APPROVED! At least that's how I perceive it!
