     Are you receiving legal help? I hope you both you and your daughter are safe and are physically away from him. I don’t know much about annulment, I believe the criteria is he has to be able to prove strong evidence of marriage fraud. As long as you have proof of abuse (including, emotional, mental, physical, financial and immigration related), and that you had a bona fide marriage along with marriage certificate, photos, letters, you will be fine. Your immigration attorney can explain in detail the document required to apply for VAWA. Police reports, restraining orders, photos, visitation schedule, written affidavits by friends, family, abusive chats, emails, text messages all count as evidence. Don’t let his empty threats scare you off. Unfortunately, these abusers rarely change. Life is very short and thank God that both you and your daughter are now away from that unsafe situation. Make sure to keep proper records and have as much documentation on his past and present abusive behavior as you can. Be safe!

If you have evidence of shared residence, such as rent receipt, lease agreement, tax filing, joint bank accounts, utility, Internet or landline bill, you can submit all these documents as evidence. Don’t let him harass or intimidate you. If he makes any threats against you and your daughters either verbally, physically, or through chats, email or text and you fear for your safety, please keep a record of it, get immediate help and report your concerns to the police, an attorney, a non-profit or shelter near you.

Everything you stated is my very same situation dear! For ny C09 EAD renewal of course! Let's wait some more and see what happens...I was told it's still within processing time! 🙌

Oh and it was sent to the wrong location but it is often redirected to the right place..just that it takes some time! That might be a factor..we just have to be patient! It was supposed to hit Vermont straight not Missouri!(NBC)

If he didn’t file for divorce yet then you should file for divorce now!!!!. Don’t file “an appearance “, but  FILE A COUNTERCLAIM.

Who has a police report doesn’t need a psychological evaluation.In your case the police report is because of physical abuse then you are good.

 

If the person has a police report because the spouse is harassing or there is no physical violence involved then the person should get a psychological evaluation.

If you filed form l765 category C9 then USCIS will issue your EAD within 5/7 months.

I remember your case..you had told us ealier about your husband's infidelity..and you were told that infidelity is not a criteria for VAWA! Well if your situation has changed and you think you now have proof to follow through by all means do file the petition! I just felt it's good to put you on the right path...for starters you can file for divorce before your spouse goes crazy with the annulment..it might be a threat but take nothing lightly at this time! Do it quick..then go from there..I really do hope for your sake you are able to provide proofs of abuse!

Get affidavits from your family(mother or any siblings ).

 

Mention the courtship in detail such as when you met your husband ‘s friends and family,mention if he spoke with your parents through FaceTime ,Skype etc.

 

How many times did  you meet your spouse’s family.Did he speak with your family often while dating?,if not why not .

 

Where and how you spent the Hollidays; mention where you used to go when dating (movies,park,dinner out, trips etc).

 

Describe when you realized that  you were in love, when you told your spouse about it and how was his reaction and vice versa.

 

How was the proposal, mention if your spouse  gave you a  ring.Who  attended your wedding  ,if you had any religious ceremony and celebration.If your family didn’t attend  the wedding explain  why not. Mention If your family called you before or after the wedding to congratulate you and your spouse .Tell about  the couple routine after the marriage etc.

Hey VJ family i know that my post is not connected with anything on this treat but i want to wish all of you a blessed week and hopefully who ever is waiting on a update on there case they will have it this week.  Also i want to say thank you to all off you amazing people for all your support and help you are amazing .
