I was actually responding to the other poster's comment about the spousal visa.

 

There is definitely a background check for K-1.  Mugshot is just a photo.  There will be documentation about his arrest that he will need to obtain.

Who knows if it is or is not a big problem.  The point is, the "big problem" comes when the criminal background is not disclosed.  He needs to be honest about the incident, and also get the documentation relating to it.

He needs to be the one to get it from the courts of wherever it happened.

Why are you doing the I-129F? The American is supposed to complete this form. Your English is somewhat limited and it’s crucial that no questions are misunderstood in this process. This particular question (concerning criminal history) is very important and an incorrect or insufficient answer can cause problems with the case. 

 

If the I-129F were intended to be completed by the beneficiary, it would be available in every language. 

Agreed. Filling the petition is not your job. Especially when you struggle with English a little bit.

안녕하세요~~ my foreign national partner did not do any of the I-129. You are very nice to help him but make sure he goes over everything because he will need to sign his name as the petitioner having completed the form. It’s also important to list the arrest even if you cannot find mugshot or thing it went away. If it was a minor offence when he was young, I don’t think it will prevent you from coming here. But if he lies and says he was never arrested, then it will be a problem.

Please have him look very closely at this question and answer it correctly.

 

You said the friend had an "electronic wedge" (I am not sure what this is, but you may mean some sort of radar detector) and that was the reason for the arrest... He needs to find out if he was arrested for a crime, or a traffic violation. If he was arrested for a crime, the answer is yes. If it was for a traffic violation, the answer may still be yes, based on additional details.
