I live just a short distance from Graceland. Me and my husband recently got chatting to a tourist visiting here from the UK. I mentioned in conversation that my parents were visiting in July for 2 weeks and that I need to apply for the ESTA's soon. and the guy's response stunned us. He said that he had criminal convictions in the UK for cocaine charges and also assault charges, but lied on his ESTA about them, stating he had no criminal history. Im shocked that his ESTA was approved with one tap of a button and his criminal history was never tracked or picked up as he was entering the USA. Surly its not that easy to lie and get away with it? Also, who would you report such fraud to in an instance like this? Me and my husband are baffled that he got away with this.

@Boiler how was he never on their radar though? can anyone lie on their esta and get in to the united states with a criminal background and not get stopped? I thought a more thorough background check would be done on anyone visiting the USA.

All ESTA is is a pre-screen tool. Anyone can lie and get an approval pretty much. Note I am not suggesting that the US and the VWP countries do not share information, I am sure that they do, but the odd one is always going to get through.

 

As for contacting ICE, by the time they got around to do anything (if they do at all) his stay will have expired and he will have left.

This. If he meets and marries a USC spouse he's going to have a much tougher time.

Just saw an article today about a woman that was honest on her ESTA about her former drug use and then wailed to the newspapers about the meanie US government not letting this honest UK citizen in for a visit. Yawn. I'm sure a lot of people lie on their ESTAs, and still others become confused by the meaning of some questions.

I've had many friends saying I should go to the newspapers with my tale of woe.

They tell me I should spin a tale about me being a hard done by military hero (Army veteran) who is being kept from my children by an evil U.S. Government over a silly mistake. The Sun and the Daily Wail love stories like that, a photo with me doing a 'sad face' would be essential.

My usual response is that no, I screwed up, I broke the rules, I have to live with the consequences.

 

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

If it is the one I read about a few days ago she was not honest, here and her friend ended up in Secondary and they found about her drug issue going through I think her Mobile. Her friend was let is, she was turned back. She blamed it on racism as she was blonde and white. Now quite why she ended up in Secondary was not made clear, as usual more to the story.

How do you know this guy wasn't lying about the cocaine charges and assault charges? Maybe he was making it up to sound macho? Tourist don't go on telling random people on Graceland about their prior criminal history, especially if they got away with it.
