Want to file for naturalization, but....

Hi folks,

 

My wife and I have been married for 6.5 years now. About 2 years ago, we got into a fight, she called the cops and I got arrested for DV, my lawyer gave me two options, either go to trial, or have a stipulated order of continuance (SOC), and have the case dismissed after 1 year without any guilty plea or finding of guilty. The case got dismissed. Now I want to apply for citizenship (I have been in the US for over 4 years now). Would I face any issues? Should I hire an attorney?

You have another thread saying you haven’t been living together and wife is thinking of divorce.

 

wait it out at least the 5 years of residency and then go from there...

and when applying you have to report the arrest and provide the court issued papers

not living with her and going for divorce ,, you can't apply with the 3 year rule

Personally, I think your attorney is right.  That probation might cause you problems....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
