Expedite i130 due to medical reason

Hello everyone I just need a little motivation. On May 31 I filed a expedite on my i130 due to extreme medical reason I call USCIS talked with someone she “claim” to be putting down the things I told her as in reason. June 4th a receive a email from USCIS stating that my request was not granted do to no reason for the expedite no evidence. So I called right away y’all with someone she explain to me that the 1st officer didn’t put any reason at all she just put in a expedite request so she tried to input another request which could not be done have to wait 5 days to do another ok I Thank the lady for her help hung up gather all my evidence made copies and straight to my local post office and over nighted my evidence. I have a letter from my doctor I have my prescription history I have my emergency room visits papers stating exactly what I was diagnosed with as my doctor says also I have the bills from emergency room I have even called my job short term disability company to insure income while I’m out due to surgery to see if I Qualify I have a letter from them about my Inquiry. Tell me if I should have waited the 5 days or did I do the right thing?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Who did you mail your papers to? Just to the service center? When you file an expedite they give you a cover letter reference of sorts so you can mail, email or fax your documents to the person who is handling it. Your first request was denied so you currently have no active request and your paperwork will either be returned or just added to your case file but no one will take action on it. You can contact your local rep for help with asking for the expedite, go to infopass to do it or wait 5 days to do it over the phone again.

You might want to look at the official USCIS criteria and tailor your request to that.  I don't see surgery listed.

Yes I mailed it directly to my service center. I read on the site you can mail the request or over the phone long as you have your case number your name Date or birth. Basically everything identifying that it is you along with a cover letter for reasons and also evidence

Well if surgeries are humanitarian reason for expedites then the term humanitarian has no specific meaning. No offense/

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

What is the humanitarian reason?  That you need someone to care for you?  Good luck but it is a mighty stretch.   

 

Even with an expedite it will be a few months before it completes.  Can you wait that long for the surgery?

In my case from what I was explained I have a rare Chronic disease called Hidradenitis Suppurative it’s basically a harmful bacteria forms in the different areas of the body that causes severe pain which mined affect my under armpit when I have a flare up basically I can not use that arm. I have been having more flare ups then normally and antibiotics are no longer working so I have to have surgery to basically remove the complete pot of my arm to remove the nodules that are infected and the healing time is 6months to a year. I could basically die from the bacteria if it’s not taken care of and keep forming.

i have the same thing though not severe.

 

i seriously doubt your case will be expedited on that

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

Expedite happen pretty quickly.  My case was expedited and a week later is was approved. 

 

Everyone case is different. My reason was for medical. 

 

It looks like the problem was that it was requested under the wrong reason. It should have been expedited under Medical 

But you have to prove why the expedite is necessary and how it relates to your case, not just that you need surgery.

Try again and find out.

I've seen people approved for less substantial reasons, and others denied with more serious medical conditions. Every expedite decision is discretionary.
