Aren’t we behind in the process?!

Hello all,

 

My husband (the beneficiary, K1 visa holder) and I applied for AOS on April 2019. USCIS received our pocket and sent us the receipt by mail on April 10th. Then on May 20th, my husband had his biometrics done. He also got a social security card saying it’s valid for work only by the permission of DHS or something( I don’t know how valuable it is). Now we still haven’t got the employment authorization card. My questions are:

1- can he apply for a job using the social security number he has?

2- how long does the employment authorization card take? 

3- can he get a Driver License ( we are in Nashville, Tennessee) 

4- I couldn’t get him with my employer benefits (health insurance) and we can’t afford buying one, is there any way he can get a health Insurance (Other than the government benefits)cuz he needs an urgent medical care and we’ve been in the ER twice and imagine the BIG bills!!

1.  He can apply all day long.  Can't work yet

2. Lately 6 to 8 months projected 

3.  Depends on TN law.  Check their website 

4.  Not until open enrollment unless you experience a qualifying event

1- Apply all you want but he can't work without an EAD

2- 4 to 6 months normally

3- check with the state

4- not sure why he could be added to your employers policy but call an indepentent insurance agent that does healthcare for options

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

getting married (also the birth or adoption of a child) is considered a life change event and most policies allow a dependant to be added.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I would check with your employer about healthcare.  Marriage is a qualifying event to be added outside open enrollment, unless you missed the window.  When I got married, my husband had to add me within 15 days otherwise we had to wait months.  Additionally, sometimes benefit admins don’t fully understand immigration matters.  I know I’ve had to explain (multiple times) about status.  (I didn’t have a SSN at the time of enrolling for benefits and they insisted I needed one.  I didn’t.  Most institution want an ssn bc it’s a unique identifier but it isn’t necessary legally). Sometimes you have to push back a little.

 

The condition on his card will mean he needs to produce an EAD or gc in order to work.  Best advice is to begin checking out the job market for his particular field, but it will be time wasted to apply/interview as most employers have a screening question about work authorization which he must answer no.
