Hi Guys,

 

I am adding my mother as a joint sponsor and her sole income is well beyond the poverty line for our family size. However, she had filed her taxes as "married filing jointly" for the past three years. Do I need to to fill out form I-864a for my step-father who was on my mother's joint tax returns?

I-864 for the petitioner.  I-864 for the Joint Sponsor.  I-864A for Husband of Joint Sponsor.

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I am not using the joint sponsor's husband income to augment my income. We are relying on the joint sponsor's income only. With that in mind, do I still have to fill I-864a?

Recommended. There have been cases when such was asked for in case of joint return even when the income from spouse of the joint sponsor wasn’t being used.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

I really wanted to avoid that but I guess I need the I-864a form. My lawyer told me that I should be fine with only I-864 form and he will add additional notes on the last page explaining why I-864a is not needed. However, I am concerned that they still ask for I-864a and I really can't afford further delays!

No, I decided not to submit I-864a even though I gathered all the documents and I was ready to submit them. According to the instruction on USCIS website on multiple places, the I-864a is only needed if the joint sponsor's income is not sufficient then I-864a form can be added to increase the overall income. So, I decided to think logically instead of staying on the super-cautious side and just hope the immigration officer who is reviewing my files knows his stuff.

any news on your case?

I did the same for my case, only filed i864. However, our case is currently at administrative processing, so not sure if it was adequate or not.

Please keep us informed on how it goes, might help others.

What is administrative processing? I thought after document submission we get a "case complete" notice and then interview schedule.

So you got AP After interview because of the i-864a not submitted?

AP is after interview if they need to review all documents further. Can take days, weeks, months.

I didn't know anything about AP. I thought the approval at the interview is the final step and there is no reviewing process after that!

Did the officer at the interview told you about administrative processing?

The only real signal of approval is when you see the status change to "Issued"........there are cases in which visas were denied after the consulate officer told the applicant their visa was approved.....and some cases have been denied during administrative processing.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
