  • are not ineligible to receive a visa under U.S. visa law. Travelers who have been arrested, even if the arrest did not result in a criminal conviction, those with criminal records, (the Rehabilitation of Offenders Act does not apply to U.S. visa law), certain serious communicable illnesses, those who have been refused admission into, or have been deported from, the United States, or have previously overstayed on the VWP are not eligible to travel visa free under the Visa Waiver Program;

There is some confusion over eligibility in some circumstances but this seems much clearer.

I would assume you was deported with UK passport so you want to try with another passport?  It is $160 to try so if you  have that to spare, then go ahead and apply. However, it does not really change the fact that you were deported probably with some ban/permanent ban. If they do not have your  Bahamian passport info, they still have your fingerprints and you are still required to disclose previous issue(s) with the Immigration.

There is zero chance using a different passport would fool the US.

Happy to be corrected with a direction to an official site that states that. Anyway only costs a few dollars to apply and OP would find out for sure.

Not how that works.  Data is shared between countries.  You can't just opt to use a different passport.

Don't even need that. US has biometric data and facial recognition software. Even if OP was ESTA eligible (which he isn't, as both Boiler and diablo have shown the regulation), he'd be pinged as soon as he tried to enter. Of course, having to apply for a visa means he gets his biometrics done for that and it's picked up there.

 Also there is a question about if YOU  ( not your passport) have ever been denied entry /deported/ whatever else.   The question is about you as a person. So unless you have had a total body /brain transplant the answer is   yes YOU have.  ( to lie is yet another lifetime ban event ) 

This will not be over quickly. You will not enjoy this.

IF the fraud charge is legit then this is a person who doesn't have a problem lying on forms.

 So if you get a life time ban while using passport A  for immigration fraud  then get a second life time ban for lying while trying to use passport B  do you need to submit 2 waivers ( and 2 fees ) to try again ? 

This will not be over quickly. You will not enjoy this.

The lifetime ban is on you, not the passport. I'm guessing a second attempt at fraud would be the nail in the coffin of any waiver attempt. Correct me if I'm wrong (I have been once before in this thread, haha) but I believe you can only submit a waiver for inadmissibility for fraud if they say you are eligible to do so after a visa attempt.

i would advise you apply with the passport you were deported with. in the past they was a 10 year ban... dont know if that still counts.... if you use the other passport... and they catch you, you might be banned for life.
