Travel to USA whilst K1 visa is in process

Timeline

I think i have seen this around VJ before but cant seem to find the topics anywhere :wacko:

Basically, I need to know if i will be able to travel to USA once our K1 process is up and running, and if so - how?

June 20th 2007.....I-129f Sent to CSC!

July 7th 2007....NOA1

November 8th....NOA2

December 8th.....Packet 3 Received (Sent back 10th)

January 8th.....Packet 4 Received

January 16th.....Interview in London

January 20th....Flight to AZ via JFK, received temp EAD

February 29th...Civil Ceremony

March 10th...I485, I765 & I131 sent to Chicago

March 22nd....Received NOA for I485, I131 & I765 (All dated March 18th)

March 24th....Received Biometrics Appointment Letter (dated March 20th)

April 7th...Request for Initial Evidence for I485 (Received in MO on the 10th)

April 9th....Biometrics Appointment

May 30th...EAD Card Production Ordered and AP Approved

June 7th....Wedding!!

June 13th...EAD Card & AP in hand

September 22nd...AOS Interview - APPROVED!

Nov 21st...Card Production Ordered!

Nov 22nd...Welcome to America Letter Received

Nov 29th 2008...Green Card Received!!!

Aug 20th 2010...Mailed I-751 to CSC

Aug 23rd...Check Cashed

Yes many do on the Visa/Waiver program from the UK, you need to be prepared to demonstrate strong ties back home, like apartment lease, letter from employer, pay stubs, ect.

Is asked so much that there is a FAQ about it.

4.6)...Can my fiance(e) come to the US to visit me once the visa process is started?

This may actually be the most common question in the newsgroup, asked on a near daily basis.

A..I wrote to the Embassy in London and I was given this reply: "If you wish to make a temporary visit to the US while your application for a Fiance(e) visa is being processed, you will require a visitor's visa (B-1/B-2) or, if you meet the conditions, travel visa-free. However, all travelers to the US are subject to inspection at the port of entry by an immigration officer who has the right to deny admissions. As the beneficiary of an approved Fiance(e) visa (petition) you may have difficulty convincing the officer that you are not an intending immigrant."

A.. If the fiance(e)..."Has a residence in a foreign country which the alien does not intend to abandon", and if the fiance(e) is "An alien coming to meet the alien's fiance(e)'s family (to become engaged; to make arrangements for a wedding; or to renew a relationship with the prospective spouse)", then they can enter the US on a B2 visa. (Quotes from the USCIS (INS) Inspectors Field Manual). This does not specifically address an alien with a "K1 visa application pending". Proving an intention to return home might mean showing...

  • Current enrollment in school
  • Employment in the home country
  • Strong family ties to the home country

This question does not have a good answer. Many people visit the US during the Process, but some newsgroupers have reported that once the initial background check is done by the Consulate, subsequent visits to the US required an additional FBI check done by the Consulate, which resulted in a delay in the visa application process. Refer questions regarding experiences to the newsgroup.

I am visiting in the US at the moment on the Visa Waiver Program. They asked a lot of questions about my work, the amount of holiday I get, when I have visited previously and how long and whether he had been to visit me in the UK. They didn't ask for any proof of ties although I had a few items such as a utility bill showing a next payment date, a pay slip and an itinerary for my next trip at the end of August.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment

we brought a bank statement of pete's and a letter from his boss saying he was to return to the UK and come back to work. it's also a good idea to have a copy of your NOA1 with you if you already have it, that way you can prove that you've started the process and are attempting to do it the legal way. hope this helps :star:

I went through Atlanta last Thursday, armed with bank statements, mortgage statement, letter from My boss saying I was taking 3 days vacation, copies of my visa NOA1 and NVC letters, free to marry letter, police record check. This was to show that I had ties to the UK and also that I was going down the legal route of getting a k1 visa. The guy never even asked to see them, just wished me luck, told me his wife was australian, suggested I move to the US because of the weather. I came back on Monday.

I hear stories about Dublin being bad. I was detained there for about an hour last year but this was before I was engaged. They gave me hell because I was staying for 3 months. They interviewed me and gave me marriage guidance, suggesting that too many brits made a bit of money in property and went over to the US every few weeks for a month or two to stay with various "girlfriends", that it was not a good way to live a life and if I was serious about my transatlantic relationship I should pop the question and make an honest woman of her!!! I was really scared at first, then really quite flabbergasted at the speech. American Airlines said they were used to it there, and waited for me and 3 other passengers despite having got all the rest of the passengers on board.

Just be honest, show what a decent, law abiding citizen you are and that you wouldnt dream of disappearing as you want to do things properly - and you will be fine.
