Do you know any story when people were denied after filing I-90? I am afraid of errors. I am not positive about the process any more.

You have already been approved.  This is just a correction of an administrative error.......there is no approval process.....

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You DON'T need to go through removal of conditions. You DO need to file form I-90 for replacement to correct the mistake and get the 10 years green card. As you must surrender your card, you get the I-551 stamp on your passport -that works as a temporary green card while you wait, so you can travel-.

 

Here are the steps you must follow:

1) Schedule an info pass at your local office.

2) Attend your info pass appointment bringing your green card, passport and marriage certificate and ask for the I-551 stamp.

3) File form I-90 and include the 2 years green card in the package. 

 

Again, once you get the stamp, you can travel and once you get the 10 years green card you no longer need to worry about interviews -unless you decide to go for the naturalization-.

Form I-90 Denied for Using Wrong Form

Every year many conditional permanent residents incorrectly file Form I-90. Conditional permanent residents should only use Form I-90 to replace a green card (i.e. lost, stolen, damaged or incorrect information). A conditional permanent resident should never file Form I-90 to renew a green card; this will result in a denial.

If you became a conditional permanent resident through marriage to a U.S. citizen or permanent resident and your conditional status is expiring within the next 90 days, file Form I-751, Petition to Remove Conditions on Residence.

And?

 

You're not renewing the card....you are replacing the card.   Even in what you quoted above, it mentions the i-90 is the correct form for conditional residents to use when replacing the card.

You're gonna drive yourself crazy if you keep worrying about what-ifs that don't even apply to your situation ;) ....your i-90 application is quite straightforward since it's due to DHS error.  Get it done as soon as you can; get the stamp as proof of your status in the interim.

As far as I understand, if you’ve been married for 2 years by the time your GC gets approved, you get the permanent GC (10 years) instead of the conditional one (2 years), after 3 years (basically 2 yrs 9 months) of having the GC, you’re eligible for citizenship, as long as you’re still married to USC spouse. Since you have retained an attorney, he should file a i90 to make the necessary corrections to your GC based on the length of the marriage. Good luck 👍🏽🍀
